HomeMy Public PortalAbout2009_04_28_R050 - Amendments to the ZO - Appellate Standard for BAR Decisions The Town of Leesburg, Virginia PRESENTED:April 28. 2009 RESOLUTION NO.: 2009-050 ADOPTED: April 28. 2009 A RESOLUTION: INITIATING AMENDMENTS TO ARTICLE 3 AND ARTICLE 7 OF THE LEESBURG ZONING ORDINANCE TO REVISE THE APPELLATE STANDARD FOR TOWN COUNCIL REVIEW OF BOARD OF ARCHITECTURAL REVIEW DECISIONS WHEREAS, Section 3.10, Section 3.11 and Section 7.6 of the Leesburg Zoning Ordinance address the process by which an applicant can appeal a decision of the Board of Architectural Review to the Town Council; and WHEREAS, the Town Council finds it necessary to clarify the appeal review criteria; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require the proposed amendments; and WHEREAS, the Leesburg Planning Commission must conduct a public hearing on the matter and forward a recommendation to the Town Council. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I: Amendments to Zoning Ordinance Article 3 and Article 7 are hereby initiated and referred to the Planning Commission to establish a de novo standard for Town Council review of Board of Architectural Review decisions on appeal. SECTION II. The Planning Commission shall hold a public hearing to consider -2- RESOLUTION: INITIATING AMENDMENTS TO ARTICLE 3 AND ARTICLE 7 OF THE LEESBURG ZONING ORDINANCE TO REVISE THE APPELLATE STANDARD FOR TOWN COUNCIL REVIEW OF BOARD OF ARCHITECTURAL REVIEW DECISIONS these amendments to the Zoning Ordinance, and report its recommendation to the Town Council pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended.
