A RESOLUTION: INITIATING AMENDMENTS TO ARTICLE 3 AND ARTICLE 7
OF THE LEESBURG ZONING ORDINANCE TO REVISE THE
DURATION OF PERMITS ISSUED BY THE BOARD OF
ARCHITECTURAL REVIEW
WHEREAS, Section 3.10.12 of the Leesburg Zoning Ordinance addresses the lapse
of approval of permits issued by the Board of Architectural Review; and
WHEREAS, the Town Council encourages regulations that provide applicants in
Leesburg a reasonable opportunity to complete projects within the time frame specified
under required approvals; and
WHEREAS, a Zoning Ordinance amendment to extend the duration of permits
approved by the Board of Architectural Review for applicants who have diligently pursued
project completion would reward such applicants for their efforts and protect them from
untimely lapses of approval; and
WHEREAS, the Leesburg Planning Commission must conduct a public hearing on
such amendment and forward a recommendation to the Town Council; and
WHEREAS, the public necessity, convenience, general welfare and good zoning
practice require the proposed amendments.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:

DURATION OF PERMITS ISSUED BY THE BOARD OF
ARCHITECTURAL REVIEW
SECTION I: Amendments to Zoning Ordinance Article 3 are hereby initiated and
referred to the Planning Commission to establish an administrative procedure to extend the
duration of Board of Architectural Review permits in accordance with specific criteria.
SECTION II. The Planning Commission shall hold a public hearing to consider
these amendments to the Zoning Ordinance, and report its recommendation to the Town
Council pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended.
