HomeMy Public PortalAbout2009_04_28_R052 - Small Watershed Grant Application The Town of Leesburg, Virginia PRESENTED: April 28. 2009 RESOLUTION NO. 2009-052 ADOPTED: April 28. 2009 A RESOLUTION: SUPPORTING A NATIONAL FISH AND WILDLIFE FOUNDATION CHESAPEAKE BA Y SMALL WATERSHED GRANT APPLICATION BY PEC AND THE CENTER FOR WATERSHED PROTECTION TO DEVELOP STORMWATER MANAGEMENT BEST MANAGEMENT PRACTICES AT FREEDOM PARK IN THE TOWN OF LEESBURG. WHEREAS, the PIEDMONT ENVIRONMENTAL COUNCIL (PEC) was established in 1972 to promote and protect Virginia's rural economy, natural resources, history and beauty; and WHEREAS, PEC as a leading advocate for land conservation and natural resources management and has secured watershed planning and improvement grants in the past that have benefitted the Town; and WHEREAS, the Leesburg Watershed Committee, the Environmental Advisory Commission, and PEC are requesting that the Leesburg Town Council support a grant application for funds to develop stormwater management best management practices at Freedom Park; and WHEREAS, the grant does not commit the town to any matching funds, but does include a expectation of staff time to participate in meetings for the planning and design of the BMPs and permit approvals as required by local regulations; and WHEREAS, the Town Council adopted Resolution 2007-89 endorsing the recommendations of the Leesburg Watershed Committee in December of 2007 including authorizing the Town to seek grants for watershed planning and improvement; and WHEREAS, the current stormwater management facilities at Freedom Park are designed for flood control and do not include measures for improving water quality; and -2- A RESOLUTION: SUPPORTING A NATIONAL FISH AND WILDLIFE FOUNDATION CHESAPEAKE BAY SMALL WATERSHED GRANT APPLICATION BY PEC TO DEVELOP STORMW A TER MANAGEMENT BEST MANAGEMENT PRACTICES AT FREEDOM PARK IN THE TOWN OF LEESBURG. WHEREAS, the design for the proposed stormwater BMPs will be agreed upon by all project partners and will ensure the continued safe use and access of Freedom Park once funding is secured; and WHEREAS, the maintenance guidelines for the stormwater facilities will be agreed upon by project partners, and Town staff may modify maintenance practices as needed to ensure the aesthetic nature of the park is not diminished and to ensure the retrofitted BMPs continue to function as designed; and WHEREAS, the Town believes that this is an excellent opportunity for further partnerships with local organizations to improve the health of our watersheds. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: To demonstrate the Town's commitment to maintain and improve the health of our watersheds, Council supports the National Fish and Wildlife Foundation Chesapeake Bay Small Watershed grant application by PEC and the Center for Watershed Protection to provide funds to implement the Town's adopted watershed strategy through development of stormwater management best management practices at Freedom Park in the Town of Leesburg subject to the following conditions: a. Town contributions shall be limited to in-kind staff support such as permit approvals and overall coordination of the project design and construction. The grant does not commit the Town to provide any matching funds, and in no event will the Town be required to provide cash funds to the project. -3- A RESOLUTION: SUPPORTING A NATIONAL FISH AND WILDLIFE FOUNDATION CHESAPEAKE BAY SMALL WATERSHED GRANT APPLICATION BY PEC TO DEVELOP STORMW A TER MANAGEMENT BEST MANAGEMENT PRACTICES AT FREEDOM PARK IN THE TOWN OF LEESBURG. b. Final design of the project, including any schedule for work on Town property must be approved by the Town. The Town reserves the exclusive right to not approve or allow to be installed design components that would conflict with Town regulations, operations or maintenance, or would adversely impact park aesthetics or operations.
