A RESOLUTION: INITIATING AMENDMENTS TO ARTICLE 14 OF THE LEESBURG
ZONING ORDINANCE TO ESTABLISH A CREEK VALLEY BUFFER
AREA FOR STREAMS THAT DRAIN GREATER THAN 100 ACRES
AND LESS THAN 640 ACRES AND TO ESTABLISH BUFFER
WAIVER PROVISIONS WHEN APPROPRIATE CRITERIA IS MET.
WHEREAS, the Natural Resource Objective 1 in the Town Plan states that the Town's
stream corridors should include a Creek Valley Buffer for areas draining more than 100 acres
and less than 640 acres to preserve, protect and restore the stream corridors; and
WHEREAS, Article 14 of the Town Zoning Ordinance does not currently provide for
such a Creek Valley Buffer; and
WHEREAS, the Town may wish to also revise Article 14 of the Town Zoning Ordinance
to include provisions to allow waivers to reduce buffer area requirements in instances that may
be deemed appropriate based on adopted criteria that is in accordance with Objective 1 of the
Natural Resources Element of the Town Plan; and
WHEREAS, the proposed amendments will align the Zoning Ordinance with the policy of
the Town Plan; and
WHEREAS, the amendments will provide the necessary criteria to protect water quality
when Creek Valley Buffers are provided and also in cases where the buffer is waived based on
acceptable criteria.
THEREFORE RESOLVED by the Leesburg Town Council as follows:
SECTION I. Amendments to Zoning Ordinance Article 14 are hereby initiated and
referred to the Planning Commission to establish appropriate Creek Valley Buffer area
requirements and also reduced buffer waiver criteria consistent with the Town Plan.

SECTION II. The Planning Commission shall hold a public hearing to consider these
amendments to the Zoning Ordinance, and report its recommendation to the Town Council
pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended.
