AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A FINAL PUD PLAN
AMENDMENT FOR PROPERTY LOCATED AT 2725 MERCHANTS DRIVE.
WHEREAS, SACA LLC, owners of the real estate hereinafter described, having submitted a
Final PUD Plan Amendment of said real estate described as follows:
Lots 26 and 27 of Baxs Commercial Property Section 2, Jefferson City, Cole
County, Missouri.
WHEREAS, it appears that the procedures set forth in the Zoning Code relating to Planned
Unit Developments have in all matters been complied with, as said property owner
submitted to the Planning and Zoning Commission and City Council a Final PUD
Plan Amendment for the above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Final PUD Plan Amendment, on file as Case No. P17008 in the Jefferson
City Planning Division, is hereby approved for the land referenced above.
Section 2. Permitted Land Uses. Permitted uses for the property shall be limited to the
permitted uses of the M-2 General Industrial zoning district with the addition of adult daycare and
child daycare as a permitted use of the property.
Section 3. Common Areas and Public Land. No common areas are proposed and no lands
are dedicated to public use with this PUD Plan.
Section 4. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

The City Council of the City of Jefferson, Missouri,will hold public hearings on the following planning and
zoning matters on Monday, May 15, 2017 at 6:00 p.m. in the Council Chamber of the John G. Christy
Municipal Building, 320 East McCarty Street, Jefferson City, Missouri.
1. 748 WEST STADIUM BOULEVARD — REZONING 0.73 ACRES FROM C-1
NEIGHBORHOOD COMMERCIAL TO C-2 GENERAL COMMERCIAL: Part of Lot 65 of
Jordan Towne Subdivision, Section 1, more particularly described as follows: From the
center of Section 11, Township 44 North, Range 12 West; thence South 85 degrees, 57
minutes, 59 seconds west, along the quarter section line,850.97 feet to the westerly right-of-
way line of Stadium West Boulevard, and the beginning point of this description; thence

Case No. P17008-2725 Merchants Drive, Amendment to Final PUD Plan. Request filed by SACA
LLC, property owner, for an amendment to the Final PUD Plan to add child daycare to the list of permitted
uses for the property. The purpose of the request is to operate an after school care within the existing
building for children with developmental disabilities age 12 and older. The property is located on the
south side of Merchants Drive 650 feet east of Highway 179 and is described as lots 26 and 27 of Baxs
Commercial Property Section 2, Jefferson City, Missouri.
Mr. Barron described the proposal and explained that the existing building on the property consists of an
industrial style building that has been converted into a mixed use medical supply distributor and adult
care facility. He stated that the owner of the adult care business is seeking approval to include child day
care services as a permitted use, with the intent of providing daycare services for developmentally
disabled children 12 years and older. Mr. Barron explained that the property is zoned PUD and the PUD
Plan for the property does not include child daycare as a permitted use. He stated that the existing PUD
Plan for the property includes adult daycare as a permitted use, and the addition of child daycare would
not be a substantial change in the permitted land uses established for the property.
Ms. Danielle Schwartz, 2725 Merchants Drive, spoke regarding this request and explained that her
organization has become aware of the unmet needs for individuals with developmental disabilities
specifically for after school care. She stated that after school care ends when children leave elementary
school. Ms. Schwartz explained that when they enter junior high and high school it is assumed that they
can take care of themselves after school with their parents not there. She stated that they started a
foundation in June 2016 and have raised enough funds that in August 2017 they can offer after school
care for older children ages 12-18 with development disabilities free of charge. Ms. Schwartz explained
that they talked with adjacent neighbors and they have expressed their support for this proposal.
No one spoke in opposition to this request and no correspondence was received.

a. The proposed amendment is requested to allow child day care services to be provided
at the Merchants Drive location. The day care services will provide after school care for
children with developmental disabilities ages 12 and older. The proposed day care will
use the same entrance as the day habilitation program currently operating at the
location. The child day care will be licensed by the Department of Health and Senior
Services.
b. No building renovation, addition, or site modifications are proposed.
c. A preliminary plot is not needed for this submittal.
d. There are no covenants, conditions or restrictions included as part of this proposal.
e. Traffic impact for the proposed use is minimal and a sit specific traffic impact study is
not required.
f. Signage details are not finalized at this time; however, all sign age will follow City of
Jefferson code requirements for the M-2 zoning district.
g. No landscaping or screening is required for this project.
h. No new parking lot lighting is required. Lighting should be limited to building mounted
security lighting. All lighting will follow City of Jefferson code requirements for the M-2
zoning district.

on the south side of Merchants Drive 650 feet east of Highway 179 and is described as lots 26 and 27 of

Nature of Request
The existing building on the property consists of an industrial style building that has been converted into a
mixed use medical supply distributor and adult care facility. The owner of the adult care business is
seeking approval to include child day care services as a permitted use, with the intent of providing
daycare services for developmentally disabled children 12 years and younger. The property is zoned
PUD and the PUD Plan for the property does not include child daycare as a permitted use.
Zoning History
The property was rezoned from M-2 General Industrial to PUD Planned Unit Development and a PUD
plan for use of the building as a mixed use adult daycare facility and medical supply company was
approved in June of 2014. The permitted uses for the property established by the PUD Plan were
permitted uses of the M-2 zoning district and adult daycare facility.

Staff Analysis
Staff recommends approval of the requested PUD Plan amendment. The existing PUD Plan for the
