PRESENT: Mayor Brad Andersen, Council members; Steve Elliott, Jane Shaw, Dan Gubler, Public Works Supervisor, Zech Prouse, City Clerk, Robyn Keyes ABSENT: Council member Dennis McArthur VISITORS: Larry Call, Terry Call, Jared Hill, Jeanna Hill, Elissa Hayward, Ms. Mann Mann, Jody Liljenquist, Marian Morgan, Larel Greenhalgh, Bruce Case Mayor Andersen brought the meeting to order and Public Works Supervisor led us in the pledge of allegiance. PUBLIC HEARING LARRY AND TERRY CALL VARIANCE REQUEST 7:00 P.M. Mayor Andersen explained the procedure for a public hearing. The Mayor told Larry and Terry Call that they would speak first and explain the reasons they had requested a variance. Next, the public had the opportunity to voice their opinion for the variance, then anyone that was neutral and just had questions. Finally, anyone that was against the variance could speak. After the public had spoken, Larry and Terry Call had the opportunity to rebut. The Council would then hold a discussion on the issue. The Mayor informed the Call brothers that the City had up to 45 days to make a decision on the hearing but they would try to do so as quickly as possible. Mayor Andersen asked if there were any questions, there were not, so he turned the floor over to Mr. Call. Mr. Call explained that they wanted to build a 6 foot fence around their drive way in order to utilize their property, which would include their front setback. The fence would be 16 feet from the side of the road to the front setback but only along the front of the driveway, the front of the house would not be fenced. Mr. Call showed the Council the sketch of their property and where the fence would be. Mayor Andersen asked Zech if he thought the sketch looked accurate, he said as far as he could tell it did. Mayor Andersen explained to the public the regulations for a fence on the front setback, which can only be 3 feet high, 4 feet if it is a material that you can see through. Council member Elliott asked if there was a reason they needed the fence 6 feet high. Mr. Call replied that it would be for privacy and to let their two dogs run in the yard and that he doesn't like people turning around in the driveway. Mayor Andersen asked if there were any more comments, Mr. Call said that they would build the fence no matter what, they would just go 35 feet back and build the fence. Public Works Supervisor Prouse asked if the 16 feet would allow enough room to access the fire hydrant that is in the front yard, Mr. Call said there was plenty of room. The Mayor asked City Clerk Robyn Keyes if all the neighbors had been notified she said that they had, the Mayor said he knew of two people that had not been notified and Robyn said that all she had to go by was the plat map and that some of the newer homes were not on the map. The Mayor suggested that for public hearing purposes that the City Clerk should go out and physically obtain the address of the neighbors. Robyn showed the Mayor the list of addresses that she had and the Mayor said 1 it looked like everyone was notified. Mayor Andersen asked if there was any one in the audience that was for the variance request, no one replied. The Mayor asked if there was any one that was neutral, no one replied. Mayor Andersen asked if there was any one against the request, Jeanna Hill said that she wasn't against the fence but wanted to make sure that the fence wasn't going up to hide how many cars are going to be parked at the Ca11 property. She said that she did not want cars stacked up on the property. Mr. Ca11 said that there would not be cars stacked up on the property and that they parked the cars there for 14 to 20 days then moved them to Rigby. Mr. Call said that they have 5 cars that belong to them and that Officer Knowles said that they would have to put in a fence to cover them up. Mayor Andersen asked what type of business they had at their property, they said they do not have a business at the property, they just park cars and their business is in Rigby. Mayor Andersen reminded them that the property was an R-1 residential area. Mr. Ca11 said that if he had to move all the cars out that he would. Mr. Call also commented on some of the other properties in Iona that had a lot of cars and junk around them and asked why they weren't being cleaned up. Mayor Andersen said that the City was working on those issues and that they were separate from their public hearing. Mr. Call said he just wanted to park his own cars on his property and that he did not have a salvage yard on the property. The Mayor asked if their cars ran, Mr. Call said they were licensed. Council member Shaw asked if the City could do anything about cars on private property, the Mayor said the City could if the cars did not run and were not registered. Mr. Call said he knew of some other properties in Iona with cars around them that he would like addressed and that he felt like he was being picked on. Mayor Andersen said that was not the case and that every one was treated equally. Mr. Ca11 asked if there was an ordinance in place that could stop the neighbors from sprinkling water on their wood fence and metal building, Mayor Andersen said that would have to be between them and their neighbors. Mayor Andersen asked if there were any more questions, Council member Elliott said he that he wanted Zech to check the measurements and make sure there was not a problem with the fire hydrant. Zech said he would. Mr. Call asked if he could have his own cars for parts and The Mayor said that if the cars did not run and were not licensed then they were considered junk. Mayor Andersen asked if there were any more questions from the Council, there were not. The Mayor entertained a motion from the council for approval or disapproval. Council member Dan Gubler said that he was concerned with the distance from the road to the fence, Council member Elliott agreed with that concern. Public Works Supervisor Prouse said the only way to be sure was to check the stakes. Council member Gubler said that if our code book stated that there needed to be a 35 foot set back for a fence that high then that is what we need to enforce. Council member Elliott made a motion to table the request until the next scheduled City Council meeting so that the Council could do a little more investigating. Council member Jane Shaw seconded the motion. Motion carried. Mayor Andersen informed the Call brothers of the next City Council meeting on July 15. Public hearing closed at 7:28 PUBLIC HEARING ELISSA HAYWARD CONDITIONAL USE PERMIT 7: 28 P.M. Mayor Andersen explained the procedure for a public hearing to Elissa Hayward then turned the time over to her. 2 Elissa Hayward explained that her sister had been the baby sitter for her children and that her sister had passed away leaving her and other family members without a daycare to take their children to. Ms. Hayward would like to operate a daycare in her home to watch the children that her sister had been watching. Ms. Hayward needed to become licensed in order to receive ICCP payments for some of the children. Ms. Hayward stated that she has had her health inspection, and after approval of a conditional use permit, she will have her fire inspection. Ms. Hayward said she was only going to watch her own family member's children along with her own. Mayor Andersen asked if any one in the audience was against the request, no one was. The Mayor asked if any one was neutral or had questions, no one did. The Mayor asked if any one was for the request, no one answered. Mayor Andersen opened the floor for questions. The Mayor asked where the specific location of Ms. Hayward's house was, she said she was two houses north of Nancy Long. Mayor Andersen asked if there was adequate parking she said that there was. Mayor Andersen asked what the hours of operation would be she said 5:30 a.m. to 5:30 p.m. Monday through Friday and that the state allowed up to 6 children but she would not have that many. The Mayor suggested to the City Council that if the request was approved then there would be certain stipulations involved such as; the City checking up every 6 months to make sure she was still in compliance. Ms. Hayward said that would be fine and that the state checked up every 4 months. The Mayor also suggested that Ms. Hayward does not have more than 7 children and the hours of operation would be from 5:30 a.m. to 5:30 p.m. Monday through Friday. Ms. Hayward said that sometimes one of the fathers is required to work late and can not pick his children up until 7:00 p.m. Other stipulations are that the conditional use permit was for Elissa Hayward only at 2977 N Olsen only, if Ms. Hayward moved, the permit would be revoked. The Mayor asked Ms. Hayward how long she would be operating a day care she said until the children could baby sit themselves and that the youngest was 4 years old. Ms. Hayward said that the stipulations were fine. The Mayor opened the floor to the Council for questions or comments. Council member Elliott requested a report every 4 months after the licensor visited her, Mayor Andersen suggested that Ms. Hayward send the City a copy of the report and Council member Elliott agreed. Mayor Andersen stated that the circumstances involved with the request for the conditional use permit were based on a hardship situation, which met the City's code requirements. Council member Elliott said he thought the day care was a great idea, Council member Gubler agreed. Mayor Andersen entertained a motion from the Council. Council member Gubler made a motion to approve the request for the conditional use permit based upon the conditions and stipulations set forth from Planning and Zoning and the City Council. Public hearing closed at 7:38 p.m. PUBLIC HEARING COLLEEN MANN VARIANCE REQUEST 7:40 P.M. Mayor Andersen explained the procedure for a public hearing to Colleen Mann. The Mayor asked Ms. Mann to present her request to the City Council. Ms. Mann handed out information regarding her variance request. Ms. Mann explained to the Council that she wanted to build a 30 x 36 foot garage to house her RV; she said that her RV had been vandalized at the last storage rental and that she would like to keep her RV on her premises. Ms. Mann is requesting a five foot variance on her side set back in order to build the garage. Ms. Mann also said that she moved the location of the garage and removed a tree to accommodate her neighbor Marian Morgan. Mayor Andersen asked if any one in the audience was against the request, no one was. Mayor Andersen asked if any one was neutral or had questions. Larel Greenhalgh asked about liability with the trees on Marian's property that bordered Mann's property on the same side as the garage. Marian also expressed concern about the new garage and the possibility of decreased property values because of the garage. Mayor Andersen and Council member Elliott both said that a garage would increase the property value. Mayor Andersen explained that keeping vehicles and equipment out in the open would decrease the property value and having things stored in a garage or shed would increase the property value. Mayor Andersen explained that if a wind storm caused one of Marian's trees to fall on Ms. Mann's garage, then that would be considered an act of God and Ms. Mann would be responsible for damage to her property. If there were damages due to negligence of the trees on Marian's part then that is a different situation. Council member Gubler gave an example that he knew of regarding damage to a property from a neighbor's tree. Mayor Andersen also informed the audience that the City Council, along with Planning and Zoning, are considering requiring only a 5 foot side set back for garages and out buildings, which would be consistent with the Bonneville County code. The Mayor asked if any one for the request would like to comment, there was no one. Ms. Mann was given the opportunity to rebut. Ms. Mann showed pictures of properties with clutter in the yard and said that is was situations like those that brought down property value. Ms. Mann also addressed the liability question and said that she had a personal liability policy with her homeowners insurance. Mayor Andersen entertained a motion from the City Council. Council member Gubler made a motion to approve the variance request to place a shop on Mann's property. Council member Jane Shaw seconded the motion. Mayor Andersen asked if there were any further discussions, there were not. Mayor Andersen asked for a roll call. Public hearing closed at 7:50 p.m. 4 Ross Johnson asked the City of Iona to deed back 30 feet of property that was supposed to be a road on Rainbow Lane. Ross explained that the property was going to be subdivided and a road was supposed to go in. The property did not get subdivided and Clay and Tammy Blekely, Ross's daughter, bought the property and would like the legal description to include the 30 feet that was going to be a road. Mayor Andersen explained to the Council that the project was too costly for the person that wanted to subdivide and that they did not continue. Ross said that he had talked with the neighboring properties and that Lyn Rockwood said he was not going to develop his property and would not need a road, French's and Bodily's said the same thing. Ross showed the Council paper work that rescinded the development agreement. Public Works Supervisor Zech Prouse commented that when the agreement was rescinded then the property should have gone back to its original state. Mayor Andersen said that it should have, but when the development agreement was rescinded, the City decided to see if the land behind the property was going to be developed and would need an access road, so the 30 feet was not given back at that time. Council member Steve Elliott noted that if the City gave back the property then that would eliminate the possibility of a future road. Council member Gubler said that there is no sense in maintaining the property. Ross said that all the other sections of Rainbow lane had been deeded back to property owners and that this is the only part that was left, which is a private driveway for Bodily's. The Mayor asked Zech what he thought, Zech said it would be a good idea to find out which direction the Blakely's are going to face their home and where the drive way would be, and if they needed to access Rainbow lane to get to their house. Mayor Andersen suggested leaving Rainbow lane as an alley. The Mayor also wanted Ross to get in writing from Lyn Rockwood that he was not going to need a road back onto his property. Council discussed if that was necessary or if a verbal agreement was alright since Lyn said he didn't want a road. Mayor Andersen asked City Clerk Robyn Keyes to go back to the Planning and Zoning minutes to see if there was information and to see if Rockwood's property was zoned RA. Council member Gubler read the mutual release of the development agreement. The Council agreed that they were comfortable with a verbal agreement from Rockwood concerning the future development of his property. Mayor Andersen entertained a motion from the Council. Council member Jane Shaw made a motion to approve a quit claim deed to return the 30 foot easement back to the original property. Council member Steve Elliott seconded the motion. All were in favor. Motion carried. Mayor Andersen entertained a motion from the Council to approve two new Planning and Zoning members. Council member Steve Elliott made a motion to approve Jared Wight and Brad Bateman to the Planning and Zoning Commission. Council member Jane Shaw seconded the motion. All were in favor. City of Iona Robyn Keyes, City Clerk NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN, that on July 1, 2008 at 7:40 P.M. the Iona City Council will be conducting a public hearing for the purpose of considering an application variance request by Colleen Mann residing at 2693 Barnes Way, Iona, Idaho. The request is to build a garage on her property at 2693 Barnes Way, and the set backs for that garage to be five (5) feet from her side property line as opposed to the regulatory ten (10) feet.
