RESOLUTION NO. 2010-022 ADOPTED February 23, 2010
A RESOLUTION: OPPOSING LEGISLATION WHICH WOULD REDUCE THE ABILITY
OF TOWNS TO PROVIDE REASONABLE COMPENSATION FOR
REASONABLE ACCESS TO ANY RIGHT OF WAY
WHEREAS, it is the position of the Leesburg Town Council that the General Assembly should
not support HB 652; and
WHEREAS, the consequences of expanding compensation for a particular access to a right of
way as opposed to reasonable access could have widespread and potentially harmful effects on our local
governments and the communities they serve; the nature and extent of these effects is unknown, and the
uncertainty associated with such a change, by itself, could be detrimental; and
WHEREAS, the financial consequences would be detrimental to the to the Town, and the
potential for claims is vast as is the cost for additional defense, compensation and transportation
expenditures; and
WHEREAS, the Council urges the Town's representatives in the General Assembly and the
House of Delegates to oppose the provisions of HB 652.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that it strongly
opposes any legislation which reduces the ability of Towns to provide reasonable compensation for
reasonable access to any right of way.
