RESOLUTION NO. 2013-14
A RESOLUTION APPROVING THE FINAL PLAT OF R AND A CONDOMINIMUMS
ADDITION SUBDIVISION, A RESUBDIVISION OF LOT 6, JOHNSTON-
POTTERFIELD SUBDIVISION, PART 2 IN TIFFIN, JOHNSON COUNTY, IOWA
Whereas, RA Holdings, LLC, as Developer, has filed with the City of Tiffin, Iowa a final
plat request for R and A Condominiums Addition, a Resubdivision of Lot 6 of Johnston-
Potterfield Subdivision, Part 2, Tiffin, Johnson County, Iowa, a subdivision to the City of
Tiffin, Johnson County, Iowa which is legally described as follows:
See attached Exhibit `A" that is incorporated into this agreement
Whereas the City and the Developer, their successors and assigns, have reduced to
terms a "Developer's Agreement" for the subdivision; and
Whereas, the final plat is found to conform with all of the requirements of the City's
Ordinances and the developer has requested the final plat approval; and
Whereas, RA Holdings, LLC acknowledges the Subdivision Ordinance requirement that
five percent (5%) of the subdivision be dedicated for open space and will pay the City a
cash -in -lieu of green space in the amount of $6,750.00; and
Whereas, The City Engineer has examined the final plat and finds it in conformity with
engineering requirements; and
Whereas, the infrastructure improvements for Streets, Water, Sanitary Sewer and
Storm Sewer are subject to two year performance and maintenance bonds per Design
Standards as approved by the City Council;
Whereas, the City Attorney has reviewed the final plat and the required legal
documents and finds them in conformity with legal requirements; and
Now, therefore be it resolved by the City Council of the City of Tiffin, Iowa that the
Mayor and City Administrator/Clerk are hereby authorized to execute the documents
necessary to approve the final plat as submitted and as approved by the City Engineer
and City Attorney, including the Developer's Agreement, Public Access and Fire
Apparatus Easement Agreement, Conditional Dedication and Conveyance, and all other
necessary documents, as a condition of its approval, contingent on the approval of the
Developer's Agreement and contingent on RA Holdings, LLC delivering a payment to
the City in the amount of $6,750.00 and contingent on the signatures of the Auditor's
Certificate, and the Treasurer's Certificate.
Be It Further Resolved that the Developer of this property will bear the cost to record
this,resolution and subsequent legal documents with the Office of the Johnson County
Recorder.
On the 13th day of February, 2013, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Bartels introduced Resolution No. 2013-14, A RESOLUTION
APPROVING THE FINAL PLAT OF R AND A CONDOMINIMUMS ADDITION
SUBDIVISION, A RESUBDIVISION OF LOT 6, JOHNSTON-POTTERFIELD
SUBDIVISION, PART 2 IN TIFFIN, JOHNSON COUNTY, IOWA and made a motion for
approval. Motion seconded by Councilperson Kahler.
Ayes: Kahler, Bartels, Upton
Nays: Phillips
Absent: Ryan
Whereupon four Council members were present and voted approval and Mayor Berner
declared that the Resolution No. 2013-14, A RESOLUTION APPROVING THE FINAL
PLAT OF R ANDA CONDOMINIMUMS ADDITION SUBDIVISION, A
RESUBDIVISION OF LOT 6, JOHNSTON-POTTERFIELD SUBDIVISION, PART 2 IN
TIFFIN, JOHNSON COUNTY, IOWA to be adopted and signified his approval of the
same by affixing his signature thereto.
Passed by the City Council on the 13th day of February, 2013.

LOT 6 OF THE AMENDED JOHNSTON - POTTERFIELD SUBDIVISION, PART 2 OF THE
NORTHEAST ONE-HALF OF SECTION 28, TOWNSHIP 80 NORTH, RANGE 7 WEST,
OF THE FIFTH PRINCIPAL MERIDIAN, TIFFIN, JOHNSON COUNTY, IOWA, IN
ACCORDANCE WITH THE PLAT THEREOF RECORDED IN PLAT BOOK 41 AT PAGE
307 OF THE RECORDS OF THE JOHNSON COUNTY RECORDER'S OFFICE. SAID LOT
6 CONTAINS 12.10 ACRES AND IS SUBJECT TO EASEMENTS AND RESTRICTIONS
OF RECORD.
