HomeMy Public PortalAbout2010_04_13_R038 - TLSE 2010-0001 Open Arms DaycareThe Town of Leesburg, Virginia PRESENTED: Apri113.2010 RESOLUTION NO.: 2010-038 ADOPTED: April 13.2010 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2010-0001, LEESBURG OPEN ARMS CHLD CARE CENTER, LOCATED AT 818 SOUTH KING STREET WHEREAS, LEESBURG OPEN ARMS has requested special exception approval to permit a child caze center to be located at 818 South King Street; and WHEREAS, the property is located in the B-2 -Established Corridor Commercial Zoning District; and WHEREAS, the Planning Commission held a Public Hearing on April 1, 2010; and WHEREAS, the Planning Commission recommended conditional approval; and WHEREAS, staff recommends conditional approval subject to the conditions contained in this resolution; and WHEREAS, Town Council has determined the proposed use meets the special exception standards for a child care center as set forth in [he Zoning Ordinance; and WHEREAS, Town Council has determined that the Approval Criteria of Zoning Ordinance Section 3.4.12 have been satisfied; and WHEREAS, Town Council has determined that the proposal would serve the public necessity, convenience, general welfaze and good zoning practice. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the Special Exception application TLSE-2010-0001, Leesburg Open Arns, is hereby approved to pemut a child care center located at 818 South King Street, and as further identified in the -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2010-0001, LEESBURG OPEN ARMS CHLD CARE CENTER, LOCATED AT S 18 SOUTH KING STREET Loudoun County Land Records as Pazce] Identification Number (PIN) 232-36-6858, subject [o the following conditions: 1. Substantial Coaformauce: Development of this special exception use shall be in substantial conformance with the Special Exception Plat entitled "Christ Community Lutheran Church DBA Leesburg Open Arms, Special Exception Plat TLSE 2010-0001," dated December 29, 2009, prepazed by Barrett Consultants, PC, and with the plat entitled, "Leesburg Open Anns Employee Parking, Arrival and Departure Zone, and Playground Capacity, South King Street Center, Leesburg, Virginia 20175," received by and stamped by the Town of Leesburg on Mazch 5, 2010. Both plats depict the existing child-care facility in Unit 1- A at 818 South King Street, and Units 1-B, 1-C, 1-D and 1-E in the same building, into which the facility is to be expanded. 2. No Expressed or Implied Waivers: Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents. 3. Compliance with State Licensing Requirements: The applicant and the proposed childcare center shall meet and remain in compliance with all state licensing requirements. 4. Hours of Operation: Hours during which child caze will be provided on-site shall be restricted [0 6:00 AM - 7:00 PM, Monday through Friday. 5. Maximum Enrollment: No more than 288 children shall be enrolled a[ this facility at any given time. 6. Number of Employees per Shift: No more than 48 employees shall work on the largest single shift of operation at this facility. The applicant shall ensure at all times that the number of staff members present onsite conform to Virginia regulations concenung child-care facilities. 7.
