A RESOLUTION: AWARDING THE LOWENBACH STREET IMPROVEMENTS, PHASE
II PROJECT CONSTRUCTION CONTRACT
WHEREAS, the Lowenbach Street Improvements project is a funded capital project; and
WHEREAS, this contract award is for Phase II of the project covering Catoctin Circle from
Edwards Ferry Road to North Street with associated work along Blue Ridge Avenue; and
WHEREAS, in response to a public solicitation for construction bids of the Lowenbach
Street Improvements, Phase II project, the Town received four bids on May 3, 2010, from the
following firms:
• Tessa Construction & Tech Company LLC $1,567,266.00
• Jeffrey Stack, Inc. $1,692,906.00
• Arthur Construction Co., Inc. $1,751,848.00
• Ardent Company, LLC $1,881,100.00; and
WHEREAS, the bids were evaluated by the Deputy Director of the Department of Capital
Projects Management and the Chief Purchasing Officer in accordance with the Town's Purchasing
Policy; and
WHEREAS, Tessa Construction & Tech Company, LLC was determined to be the lowest
responsive and responsible bidder; and
WHEREAS, this is a unit price contract and the estimated quantities multiplied by the unit
price have established the not to exceed contract price; and
WHEREAS, change order procedures are detailed in the bid specifications; and
WHEREAS, no additional funding is needed to award this contract.

A RESOLUTION: AWARDING THE LOWENBACH STREET IMPROVEMENTS, PHASE
II PROJECT CONSTRUCTION CONTRACT
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute a contract, in a form approved by the Town Attorney, with
Tessa Construction & Tech Company, LLC in the amount of $1,567,266.00 for the construction of
this project.
