A RESOLUTION: INITIATING A TOWN CODE AMENDMENT AUTHORIZING THE
SERVING OF ALCOHOL ON TOWN GREEN BY ADJACENT
BUSINESSES
WHEREAS, it is the current practice of the Town to issue a permit to allow businesses
adjacent to Town Green to maintain a limited number of dining tables on the Town Green for patio
seating; and
WHEREAS, the Town staff have explored the logistical and liability requirements for the
serving of alcohol on Town Green; and
WHEREAS, the permission to serve alcohol would be restricted to businesses adjacent to
the Town Green which have a means of egress and ingress directly to the designated serving area
that does not span beyond 10 feet ;and
WHEREAS, the Town Code must be amended to authorize the serving of alcohol on the
Town Green by adjacent businesses; and
WHEREAS, the Town would require a Memorandum of Agreement between the Town and
the business serving alcohol; and
WHEREAS, the Memorandum of Agreement would identify terms of use that include but
are not limited to the designated serving area, blackout dates for use, indemnification, and breech
of contract terms; and

WHEREAS, any business serving alcohol on Town Green would be required to adhere to
all Alcohol Beverage Control Bureau regulations, as well as submit to the Town liquor liability
insurance naming the Town of Leesburg as additionally insured.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that an
amendment to the Town Code is initiated to authorize the serving of alcohol on the Town Green by
adjacent businesses and the Town Manager is authorized to enter into a Memorandum of Agreement
with the business in a form acceptable to the Town Council.
