A RESOLUTION: INITIATING AMENDMENTS TO ARTICLE 13 OF THE
LEESBURG ZONING ORDINANCE TO PERMIT
COMMERCIAL STRUCTURES IN THE FLOODWAY FRINGE
AND TO ADD DEFINITIONS AND UPDATE REFERENCES
WHEREAS, the Town Council adopted the Crescent District Master Plan on June
27, 2006; and
WHEREAS, Chapter XIII of the Crescent District Master Plan identifies a multi-
parcel area in the B-1 District where amixed-use development could be developed as Site
"b" on the Selected Opportunity Sites Map; and
WHEREAS, in order to obtain planned economic redevelopment in the subject
area Article 13 Flood Protection should be amended to permit commercial structures in
the floodway fringe in accordance with the standards and criteria of the Federal
Emergency Management Agency; and
WHEREAS, appropriate definitions for floodplain terms and references to
floodplain studies and programs in Article 13 should also be updated; and
WHEREAS, these amendments will provide enhanced redevelopment opportunities
in accordance with the Crescent District Master Plan and the Town Plan; and
WHEREAS, the public necessity, convenience, general welfare and good zoning
practice require the proposed amendments.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:

RESOLUTION: INITIATING AMENDMENTS TO ZONING ORDINANCE
ARTICLE 13
SECTION I. Amendments' to Zoning Ordinance Article 13 are hereby initiated
and referred to the Planning Commission to permit commercial structures in the floodway
fringe in accordance with the standards and criteria of the Federal Emergency
Management Agency and to establish appropriate definitions and update references in the
area identified as Site "b" under Chapter XIII Selected Opportunity Sites.
SECTION II. The Planning Commission shall hold a public hearing to consider
these amendments to the Zoning Ordinance, and report its recommendation to the Town
Council pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as
amended.
