PRESENT: Mayor Brad Andersen, Council members; Jane Shaw, Dan Gubler, Dennis McArthur, Public Works Supervisor Zech Prouse, Police/Code enforcement officer Shannon Basaraba, Clerk Robyn Keyes. ABSENT: Council member Steve Elliott, Treasurer Ron Nelson. VISITORS: Dana Andersen, Jay Shaw, Robyn Prouse, Linda McArthur, Robalyn Gubler, Shawna Basaraba, Joel Keyes. Mayor Andersen brought the meeting to order and asked Council member Gubler to lead the discussion for the first item of business. POLICE/CODE ENFORCEMENT Council member Gubler explained that he had found a government vehicle for sale through the US Forest Service that would be a good choice for replacing Iona's current police car. The vehicle is a 2002 Chevrolet Tahoe with 70,000 miles on it. The price is $7,700 and is in excellent condition. The council discussed the specifics of the vehicle and agreed that the Tahoe would be a good choice for a new police car. Mayor Andersen suggested that $5,000 should be taken out of the general vehicle equipment replacement fund and the rest taken out of the police account. Council member Gubler made a motion to purchase the vehicle for the purpose of replacing the existing police vehicle. Council member Shaw seconded the motion. All were in favor. Motion carried. Officer Basaraba talked about drafting a parking ordinance for our city streets in order to effectively cite any person that is parking illegally, and would give people time as a learning curve to be implemented to see what sort of parking regulations are necessary for our City. Officer Basaraba will draft the ordinance for the attorney to review and the issue will be discussed further at the next City Council meeting. WATER ISSUES Officer Basaraba would like to have the existing ordinance for delinquent water bills to be revised with stricter guidelines and a greater percentage rate for the interest. Officer Basaraba will draft the proposed changes and put in Council's box for review. Mayor Andersen noted that the $10 administration fee that was approved earlier this year had not been added to the ordinance and that he would discuss the matter with the attorney. Mayor Andersen asked Public Works Supervisor Prouse what the status of the water tank was. Supervisor Prouse said that the VFD and SCADA were ready to go and that he was just waiting for the seasonal demand for water to reduce before he takes the tank off-line for evaluation. Mayor Andersen said that the engineer Keller was ready to evaluate once we are ready. 1 COUNCIL REPORTS Mayor Andersen reminded that protocol needed to be followed regarding agendas and that if each Council member had an issue that they wanted to discuss other than the committees they were overseeing, that issue needed to be added to the agenda 48 hours before the Council meeting. Mayor Andersen also said that he would like to see the items of business from the previous month that are to be discussed again in the current month placed first on the agenda, and a time for planning and zoning along with our police officer to give reports on the agenda. Mayor Andersen reviewed the Committees that each council was to over see. Council member Shaw; library and senior center. Council member Elliott; tree committee and historical committee. Council member Gubler; parks and recreation. Council member McArthur; tree committee and the Lion's Club. Council member Shaw made a motion to adjourn. Council member Gubler seconded the motion. All were in favor. Adjourned 7:05 p.m. 2 LEI G Cum\1E -T-Ts‘-\6Lk_\n C. 7"1, F FE CT' 9-4-5: PARKING/STORING FOR CERTAIN PURPOSES PROHIBITED: (A) No person engaged in the acquisition or sale of vehicles shall park or place a motorized/non- motorized vehicle or any other item upon any street, alley, parkway, or city right of way for the purpose of selling or offering the same for sale or rent. For the purposes of this section, a person "engages in the sale of vehicles" if he holds himself out, by any means whatever, as accepting or willing to accept vehicles for sale. (B) It shall be unlawful to park or place any motorized vehicle, non -motorized vehicle, or any other item upon any street, alley, or parkway for more than 7 continuous days. (C) It shall be unlawful to park any trailer or motor -home within the city right of way except for the expeditious loading and unloading of goods and materials. (D) It shall be unlawful to park or place any motorized vehicle, non -motorized vehicle, or any other item upon any street, alley, or parkway, from and including, Thanksgiving to Easter Sunday, except for the expeditious loading and unloading of goods and materials. (E) Nothing contained in this chapter shall be construed to prohibit emergency vehicles, or vehicles operated by physicians on emergency calls, from parking or standing such a motor vehicle in a zone where parking or standing is otherwise prohibited during the course of said emergency call. 9-4-20: ENFORCEMENT ON PRIVATE PROPERTY (A) No person shall stand or park a vehicle on any private lot or lot area without the express or implied consent of the owner thereof. Whenever signs or markings have been erected on any lot or lot area, contiguous or adjacent to a street, thoroughfare or alley indicating that no vehicles are permitted to stand or park thereon, it shall be unlawful for any person to drive a vehicle across any curb or lot line or over any driveway from a street or alley into such lot or area for the purpose of standing or parking such vehicle, or for any person to stop, stand or park any vehicle in such lot or lot area. 9-4-22: NOTICE OF PARKING VIOLATIONS (A) A notice of a violation of the parking regulations of this chapter may be issued by any police officer or by any person duly authorized by the Chief of Police or City Council. The notice of violation shall be issued by placing it on the windshield of any illegally parked vehicle, in a secure manner, or in a prominent place therein. A separate notice shall be issued for each parking regulation violated. If the violation is overtime parking, a separate notice shall be issued for each hour, or fraction thereof, the owner or operator of the vehicle allows it to remain parked in violation of this chapter. (B) The notice of violation shall state the date and time when it is issued and the nature of the parking violation observed. The notice shall advise the owner or operator of the vehicle that he or she must admit the violation and pay the penalty on or before the stated court date, or appear before the Bonneville County Magistrates Court on said court date. In default of which a summons and criminal complaint may be served upon such person. (C) Any person issued a parking notice may enter an admission in the following ways: (1) Depositing the notice of violation with the amount of penalty stated thereon in any collection box designated by the Police Division: (2) Mailing the notice of violation with the amount of the penalty stated thereon to the address indicated on the notice; or (3) Presenting the notice together with the amount of the penalty indicated thereon at the office of the City Treasurer. 9-4-23: PENALTIES (A) Any person who violates any parking regulation herein is guilty of any infraction and shall be subject to penalties as follows: (1) If the violator pays the penalty or appears before the Magistrates Court and enters a plea at or before the court date, the penalty, upon conviction or admission, shall be as follows: (a) Violation of any parking regulation in Chapter 4, except 9-4-19 (Handicapped Parking), is $20.00. (b) Violation of 9-4-19 (Handicapped Parking) is $50.00. (2) If a person violates any parking regulation and he or she fails either to appear before the Magistrates Court on said court date or fails to pay the penalty as provided in the previous subsection, on or before said court date, the penalties shall be as follows: (a) Violation of any parking regulation in Chapter 4, except 9-4-19 (Handicapped Parking), is $2.00 each and every day thereafter until the fine is paid in full or the maximum of $50.00 has accrued. (b) Violation of 9-4-19 (Handicapped Parking) is $2.00 each and every day thereafter until the fine is paid in full or the maximum of $100.00 has accrued. Section 8-2-34 of the lona City Code is hereby amended as follows: 8-2-34: DELINQUENT ACCOUNTS: Whenever a customer account is not paid within forty (40) days from the past due date, the City Clerk shall assess a delinquency charge in the amount of $5 for each month the account is delinquent. The City shall also terminate water service to the delinquent customer seventy (70) days after the past due date. In such event, a disconnect fee in the amount of $25.00 shall be added to the bill. Interest at a rate of five percent 5% per month shall accrue on the unpaid balance of all delinquent accounts, including any unpaid delinquency charges or disconnect fees. If service is terminated for delinquency, it shall not be restored until the account is brought current. In order for service to be restored, the delinquency charge, $10 administration fee, $25 disconnect fee, and the $25 reconnect fee must be paid in full, unless a written agreement for payment is approved by the Council. The disconnect fee shall be payable whenever a service trip is approved by the Council and/or the Chief of Police. The disconnect fee shall be payable whenever a service trip is approved for the purpose of disconnecting water service, even if the service does not actually get disconnected. Partial payments shall be applied first to any unpaid delinquency charges, disconnect fees, administrative fees, reconnect fees, and then to the outstanding utility charges in the same order as the utility charges were accrued. NOTICE OF SPECIAL CITY COUNCIL MEETING NOTICE IS HEREBY GIVEN, that the Iona City Council will convene a special City Council Meeting.
