A RESOLUTION: INITIATING AN AMENDMENT TO SECTION 34-29 (b) (AVAILABILITY
CHARGES FOR WATER SERVICE), DNISION 1(GENERALLY), ARTICLE
II (WATER SYSTEM), CHAPTER 34 (UTB.ITIES) OF THE TOWN CODE
WHEREAS, i[ is important [o frequently evaluate tools available [o atfectively attract and retain
business to the Town; and
WHEREAS, a[ their August 4, 2010 meeting, [he Economic Development Commission voted
unanimously m recommend [ha[ the Town Council initiate an amendment to [he Town Code regarding
utility availability fees; and
WHEREAS, an amendment [o the Town Code allowing for the amortization of Utility
Availability Fees to coincide with the term of a business's lease, if applicable, not [o exceed five years
would work to attract new businesses [o the Town.
THEREFORE, RESOLVED [ha[ the Council of the Town of Leesburg in Virginia hereby
authorizes staff to initiate an amendment [o Section 34-29 (b) (AVAILABILITY CHARGES FOR
WATER SERVICE), Division I (GENERALLY), Article II (WATER SYSTEM), Chapter 34
(UTILITIES) of the Town Code [o extend the amortization of utility availability fees, afrer [he first
$10,000, [o a term coinciding with the business's lease not to exceed five years.
