A RESOLUTION: TO APPROVE VETERINARY HOSPITAL SPECIAL EXCEPTION USE
FOR TLSE-2010-0003, TOWNE ANIMAL CLINIC
WHEREAS, a Special Exception application with a Special Exception Plat has been filed by
Towne Anima] Clinic, and is referred to as TLSE-2010-0003, Towne Animal Clinic; and
WHEREAS, the subject property is located at 64 Plaza Street, and is further described as
Loudoun County Parcel Identification Number (PIN) 188-26-2026; and
WHEREAS, the property is zoned B-2, CommuniTy RetaiUCommercial District; and
WHEREAS, the Planning Commission held a Public Hearing on August 5, 2010; and
WHEREAS, a[ their regular meeting of August IQ, 2010 the Planning Commission
recommended conditional approval of this application to the Town Council; and
WHEREAS, Staff recommended conditional approval subject to the conditions identified in
the Town Council Staff Report dated July 3Q, 2010; and
WHEREAS, Town Council has determined the proposed use meets the special exception
standards for a Veterinary Hospital as set forth in the Zoning Ordinance Section 9.3.30 Veterinary
Hospitals; and
WHEREAS, Town Council has determined that the Approval Criteria of Zoning Ordinance
Section 3.4.12 have been satisfied; and
WHEREAS, Town Council has determined [hat the proposal would serve the public
necessity, convenience, general welfaze and good zoning practice.
THEREFORE, RESOLVED by the Council of [he Town of Leesburg in Virginia as follows:
SECTION I: That the Special Exception application TLSE-2010-0003, Towne Animal

Clinic, is hereby approved ro permit a veterinary hospital on the property at 64 Plaza Street, having
a Loudoun County Parcel Identification (PIN) number 188-27-0808, to the following conditions:
1. Substantial Coutormauce: Development of this special exception use shall be in
substantial conformance with the Special Exception Plat, last revised 28 July 2010, and
prepared by Wolford & Chen, P.C.
2. No Expressed or Implied Waivers: Approval of the special exception does not
express or imply any waiver or modification of the requirements set forth in the
Subdivision and Land Development Regulations, the Zoning Ordinance, or [he Design
and Construction Standazds Manual (DCSM) except as specifically approved by Town
Council or as shown as approved by Town Council on the Special Exception Plat and
supporting documents.
3. Corrections to the Plat: Prior to the certification of the Special Exception Plat, the
following corrections must be made:
a. Note #8: Cortect the square footage from 11,942 to 11,943
b. Eliminate [he last sentence in Note #16. The footnote in the Plant List Table
identifies the role of the Urban Forester.
4. Location and Area: The location of the veterinary hospital may be located in any part
of the 11,943 square foot building located at 64 Plaza Street. The use of the veterinary
hospital is limited 11,943 square feet or the limits of the first floor of the existing
building as depicted on the special exception plat.
5. Hours of operation: The use of the veterinary hospital shall be limited to the hours of
7 am to 11 pm. While not open for business, veterinary staff will be present overnight
to care for hospitalized patients.
6. Sound Proofing: To ensure compatibility with the adjacent tenant spaces of the
building and surrounding residential uses, and to comply with TLZO Section 9.3.30,
the Applicant must demonstrate, at [he time of building permit, the application of
acoustical material to any wall used to enclose patient boarding or holding areas. An
inspection at the time of occupancy permit will be required to verify the installation of
acoustical material. The acoustical material is required to mitigate potential noise
trespass onto or into adjacent tenant spaces.
7. Limitation on Outdoor Activity: The Applicant is prohibited from conducting any
outdoor activities involving patients under their care.
8. Dumpster: All containers used for [he collection of waste must be kept within the
enclosure. The enclosure should be sized large enough [o accommodate the number of
anticipated dumpsters as well as any containers for recycling, or cooking by-products.

9. Parking Signage: "No Parking" sign must be located in the azea of any pavement
sViping used to prohibit parking.
10. Handicap Ramps and Spaces: Provide topographic information along with the
graphic depiction of the required handicapped accessible parking spaces and the
striped crosswalk provided for the proposed uses to enable staff to de[ernine if the
pazking spaces and accessible route meets ADA access requirements and DCSM ]0-
120.2](6). The Applicant should be aware that this information is required prior to the
issuance of any occupancy permits.
11. Pavememt Stripimg: The paved azea of the property shall be pain[ed/striped to reflect
the pazking space and drive aisles as dimensioned on the special exception plat, in
accordance with TLZO Section 11.6.2.C and Section 11.6.5.
12. Lighting: Prior to the issuance of any occupancy permits, the Applicant must
demonstrate to the satisfaction of staff that the existing outdoor lighting fixtwes are
full-cutoff.
13. Landscape Management Plan: The footnote under the Plant List Table on the Special
Exception Plat identifies a detailed landscaping plan. This detailed landscaping
management plan shall be prepazed in consultation with a certified azborist. The
landscaping management plan should clearly identify which trees aze to be replaced
due to poor health and their replacement trees. The landscaping management plan
should also identify replacement trees in the event that the existing trees aze damaged
or destroyed.
ta. Waste Disposal: All pharmaceuticals, vaccines and antibiotics will be packaged and
labeled by manufactures as required by the FDA. All medical wastes, pharmaceuticals,
vaccines and antibiotics shall be disposed of according to FDA standazds. Al] animal
waste shall be disposed of according to federal, state, or local requirements.
