RESOLUTION NO. 2010-152 ADOPTED November 30, 2010
A RESOLUTION: AUTHORIZING THE MAYOR TO EXCECUTE THE DEED TO
RELEASE FOR THE DEDICATION OF PUBLIC RIGHT OF WAY
WHEREAS, In June of 1992 the Town was to be the beneficiary of a conditional dedication
for public right away if certain conditions were met; and
WHEREAS, The four corners of the intersection of Edwards Ferry and the Route 15 by -pass
must be utilized for interchange purposes; the dedication could only be used for the purpose of an
interchange; the interchange construction drawings were to be approved, funding obtained, and
contract awarded by May 10, 2010; and
WHEREAS, The Town was unable to fulfill the above conditions; and
WHEREAS, CH Realty III /Battlefield, LLC has requested that the Town formally release the
conditional dedication in order to clear the title.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that the
Mayor is authorized to execute the Deed of Termination upon its approval by the Town Attorney.
