Number: 95-4739674, hereinafter called the ARCHITECT -ENGINEER. WITNESSETH, that whereas the Owner and the Architect -Engineer entered into Agreement on November 30th, 1999, for implementing the Schematic Design Phase of this Project; that whereas this has now been completed and the Owner wishes to add the Design Development, Construction Documents, Bidding, and Construction Administration Phases to this Agreement; that whereas this is the purpose of this Amendment. NOW THEREFORE, in recognition of the good and valuable considerations exchanged between the parties, the Owner and the Architect -Engineer hereby covenant and agree to amend this Agreement as follows: GENERAL: Those Articles and Exhibits not specifically addressed in this Agreement shall remain force. 2.1 For his Basic Services prescribed in Article 3, Sections 3.1 through 3.7.1 (18) hereinafter, the lump sum amount of $344,250.00, to be paid as prescribed in Article 9.1 hereinafter. 1 J. • 9.1 PAYMENTS ON ACCOUNT OF ARCHITECT -ENGINEER'S SERVICES (1) For his Basic Services, payments shall be made at the completion of each phase of the work in proportion to services performed as follows: Schematic Design Studies Phase $ 29,261.00 Design Development Phase Upon Submittal of Documents 37,867.00 Upon Approval of Documents 37,868.00 Construction Documents Phase Upon Submittal of Documents 79,177.00 Upon Approval of Documents 79,178.00 Bidding Phase 12,049.00 Construction Administration 68,850.00 Totals $ 344,250.00 (2) Payments for Additional Services of the Architect -Engineer as defined in Article 4 hereinabove, as a Lump Sum shall be made as prescribed in the Authorization. (3) Payments for Additional Services of the Architect -Engineer's services as defined in Article 4 hereinabove as a Multiple of Actual Payroll Costs, and for Reimbursable Expense as defined in Article 8 hereinabove shall be made monthly upon presentation of a detailed invoice. (4) Forty (40) -calendar days shall be allowed for the Owner's inspection and approval of the goods and services for which any invoice has been submitted. 2 IN WITNESS WHEREOF, the parties hereto have executed this Agreement the day and year first written above.
