INITIATING AN AMENDMENT TO THE LEESBURG
ZONING ORDINANCE TO PERMIT A CREMATORIUM AS
AN ACCESSORY USE TO A FUNERAL HOME IN THE B -1
COMMUNITY (DOWNTOWN) BUSINESS, THE B -2
ESTABLISHED CORRIDOR COMMERCIAL AND THE B -3
COMMUNITY RETAIL /COMMERCIAL ZONING DISTRICTS
WHEREAS, the Town regulates uses in the B -1 Community (Downtown)
Business, the B -2 Established Corridor Commercial and B -3 Community Retail
Commercial Zoning Districts through Articles 6 "Nonresidential Districts and Article
9 (Use Regulations) of the Leesburg Zoning Ordinance to protect the health, safety, and
welfare of its citizens; and
WHEREAS, Town Council supports increased economic development
opportunities throughout Town and strives to address market demands of the Town's
residents and business community; and
WHERAS, cremation as a form of disposition of the deceased is growing
nationwide; some statistics claim as many as thirty -two percent of Americans are currently
turning to cremation services.
WHEREAS, the Town has been asked to consider the addition of crematoria as an
accessory use to funeral home uses; and
WHEREAS, advances in cremation technology makes it possible to potentially
add a crematorium to funeral home operations that will not pose adverse impacts on
neighboring properties or to the environment when properly installed.
WHEREAS, the public necessity, convenience, general welfare and good zoning
practice require the proposed amendments.
RESOLUTION: INITIATING AN AMENDMENT TO THE LEESBURG ZONING
ORDINANCE TO PERMIT A CREMATORIUM AS AN
ACCESSORY USE TO A FUNERAL HOME IN THE B -1
COMMUNITY (DOWNTOWN) BUSINESS, THE B -2
ESTABLISHED CORRIDOR COMMERCIAL AND THE B -3
COMMUNITY RETAIL /COMMERCIAL ZONING DISTRICTS
as follows:
SECTION I. Amendments to the Zoning Ordinance are hereby initiated and
referred to the Planning Commission to consider the addition of Crematorium, whether
by special exception or by right with minimum use standard regulations to be determined,
as an accessory use to Funeral Home uses in the B -1 Community (Downtown) Business
Zoning District, the B -2 Established Corridor Commercial Zoning District and the B -3
Community Retail /Commercial Zoning District and to update references and definitions
as may be needed to meet such standards.
SECTION II. The Planning Commission shall hold a public hearing to consider
these amendments to the Zoning Ordinance, and report its recommendation to the Town
Council pursuant to Chapter 22, Title 15.2 -2204 of the 1950 Code of Virginia, as
amended.
