A RESOLUTION APPROVING THE FINAL PLAT AND ACCEPTING STREET,
WATER MAINS, SANITARY SEWER AND STORM SEWER, BUT NOT SIDEWALKS
OF WOODFIELD RIDGE — PART THREE, A SUBDIVISION OF TIFFIN, JOHNSON
COUNTY, IOWA
Whereas, Woodfield Ridge, LLC, as Subdivider has filed with the City Clerk of the City
of Tiffin, Iowa, an application for approval of the final plat of Woodfield Ridge -Part
Three, a subdivision of Tiffin, -Johnson County, Iowa, which is legally described as
follows:.
See attached Exhibit "A" that is incorporated into this agreement
And Whereas, The City Engineer will do a final examination of the final plat and provide
his recommendation on approval of the final plat to the Council;
And Whereas, the City hereby acknowledges the subdivision ordinance requirement
that five percent (5%) of the subdivision be dedicated for open space in Part Three will
be Lot A and Outlot A.
And Whereas, the City and the Subdivider, their successors and assigns, have reduced
to terms a° Subdivision Agreement will be recorded with Johnson County;
And Whereas, the infrastructure improvements for Streets, Water, Sanitary Sewer and
Storm Sewer, are subject to two year maintenance bonds per Design Standards as
approved by City Council;
Whereas, the final plat is found'to conform with all of the requirements of the City's
Ordinances and Subdivision Agreement with the exception of sidewalks within
Woodfield. Ridge -Part Three, and any payment of fees due to the City by the Subdivider.
Now, therefore be it resolved by the City Council of the City of Tiffin, Iowa that the
Mayor and City Administrator/Clerk are hereby authorized to execute the documents
necessary to approve the final plat as submitted and as approved by the City Engineer
and City Attorney, including the Subdivision Agreement, and all other necessary
documents, but, as a condition of its approval, the approval of the Subdivision
Agreement and the final plat are contingent on the following: 1) Woodfield Ridge, LLC
delivering a performance bond or escrow funds to the City, which is acceptable to the
City Engineer and City Attorney, in the amount of $15,000; 2) Woodfield Ridge, LLC
delivering a maintenance bond to the City, which is acceptable to the City Engineer and
City Attorney; 3) Execution by the Subdivider of the Subdivision Agreement; 4)Payment
of fees; 5) Execution by the Subdivider of all other documents required by the
Subdivision Ordinance or Subdivision Agreement, including easement agreements; 6)
Execution by Hills Bank of the Consent of Mortgagee to Subdivision; 7) The City
receiving final recommendations on final plat approval from the City Engineer. The final
plat may not be recorded and no lots may be transferred until these contingencies have
been completed. The recording of the plat and this resolution will indicate these
contingencies have been' completed.
Be It Further Resolved, that the Subdivider of this property will bear the cost to record
this resolution and subsequent legal documents with the Office of the Johnson County
Recorder.
On the 6t" day of March, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Resolution No. 2013-031, A RESOLUTION
APPROVING THE FINAL PLAT AND ACCEPTING STREET, WATER MAINS,
SANITARY SEWER AND STORM SEWER, BUT NOT SIDEWALKS OF WOODFIEL'D
RIDGE — PART THREE, A SUBDIVISION OF TIFFIN, JOHNSON COUNTY, IOWA
and made a motion for approval. Motion seconded by Councilperso'n Bartels.
Ayes: Phillips, Upton, Bartels, Ryan, Kahler
Nays: None.
Absent: None.
Whereupon five Council members were present and voted approval and Mayor Berner
declared that the Resolution No. 2013-031, A RESOLUTION APPROVING THE
FINAL PLAT AND ACCEPTING STREET, WATER MAINS, SANITARY SEWER AND
STORM SEWER, BUT NOT SIDEWALKS OF WOODFIELD RIDGE — PART THREE,
A SUBDIVISION OF TIFFIN, JOHNSON COUNTY, IOWA to be adopted and signified
his approval of the same by.affixing his signature thereto.
