TOWN OF BREWSTER MINUTES OF COMPREHENSIVE WATER PLANNING COMMITTEE REGULAR MEETING Monday July 27, 2009 at 4:30 P.M. Brewster Town Office Building Comprehensive Water Planning Committee Pat Hughes convened the Comprehensive Water Planning Committee meeting at 4:35 pm in the Brewster Town Office Building with members Dave Michniewicz, Joanne Hughes, and Elizabeth Taylor. Also Present: Sue Leven, Jim Gallagher and Peter Johnson. Ed Lewis arrived at 4:45 and Chris Miller arrived at 4:50 pm. P. Hughes noted that unfortunately Jane Evans had submitted her resignation from the committee. P. Hughes wanted the committee to know that there was flexibility with the meeting time. She did not want members to have a conflict due to the day/time. 1. Status report on RFP review by Town Administrator: Leven reported that the RFP had been submitted to the Town Administrator and to Town Counsel. She was hoping to receive their comments in the next day or two. P. Hughes: Asked what the timeframes was for sending out the RFP? Leven: Before the next meeting. 2. Review of Draft Water Quality Protection By-law amendments. Leven: Provided an overview of the revisions: 1. The Attorney General's comments have been incorporated 2. Dave Bennett and Sue Leven suggested changes they have been incorporated. Of particular importance is the fact the existing bylaw applies the 5 ppm nitrogen load throughout town. In addition, there was only science to support the need to have this apply in the Zone I, Zone II and watershed areas. It was also noted that most citizens were unaware that this bylaw would apply to the entire town because the summary indicated only Zone I/II and watersheds. Leven: Distributed and discussed the map from the Cape Cod Commission showing the water resource areas, both existing and potential. Michniewicz: Was not in favor of the by-law changes that went to Town Meeting in November 2008. He felt that the regulations should follow the science. This is a significant change and should wait until data is available to support it. ~~. . ,,,`{ ~ Y ~ ~ ~`)_ Lewis: It was his understanding that when the bylaw was drafted it applied to Zone I and Zone II. It was a last minute change to have it apply across the town. ,~ Taylor: Supports the 5/ppm across town and/or some other restrictions that will proteCt~our lens. She felt there was science available that backed up the need for 5 ppm. 07-27-09 www.TOWN.BREWSTER.MA.US Page 1 oft A lengthy discussion revolved around enforcement and the ramifications of town wide vs. Zone I/II. In addition, a discussion around single family home exemptions and the need to establish guidelines for residential use. Other Business: 1. Review minutes: May 15, 2009; June 22, 2009; June 29, 2009; July 13, 2009 and July 27, 2009 - Due to the time, it was agreed to discuss this at the next meeting. 2.
