Mayor Tyrell called the regular meeting of the City Council to 2. order at 7:30 P. M. Rev. Harvey T. Booher, of the First Southern Baptist Church, 4856 Golden West Ave., gave the invocation, 3. following which Mayor Tyrell led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen-Clemson, Harker, Merritt, Tyrell ABSENT: Councilman - Beckley Councilman Harker moved that Councilman Beckley's absence be ex- cused as he was representing the City at the Sister City Confer- ence in Mexico, Councilman Clemson seconded, and the motion was unanimously carried. ALSO PRESENT: City Manager Koski, Planning Director Dragicevich, Public Works Director Pizzorno, Parks & Recreation Director Kobett 5. APPROVAL OF MINUTES: Regular Meeting of August 2, 1966. City Manager Koski corrected the third line on page three from "One the first one" to "On the first one "; also page 3 the third paragraph second line reads "instruct the City Manager" correct- ed to read "instruct the Supt. of Streets ". Councilman Clemson moved to approve the Council Minutes of August 2, 1966, as corrected, Councilman Merritt seconded, and the motion carried unanimously. PUBLIC HEARING: CONT'D: 7 :30 P. M. re recommendations regulating use of kennels veterinar operations and small animal hos•itals Planning rector 'ragicevic ,reporte. °cn the findings of the joint meeting of the City Council and Planning Commission to study the kennel operations. He advised the consensus of opinion was as follows: 1. All new operations will require a conditional use permit processed through the Planning Commission and City Coun- cil 2, Existing kennels will be classified "Non- Conforming" subject to following understanding: a) They will not be required to obtain a Conditional Use Permit. b) No amortization or abatement period will be prescrib- ed. c) Structural alterations will be permitted upon the pre- mises; provided that whenever more than fifty percent of the value is altered or extended within any three year period on premises constituting commercial ken- nels, the entire operation will have to apply for and be issued a Conditional Use Permit. 3. Annual licenses will be required together with inspec- tions to assure: a) Enforcement of the conditions of the permit, if any; b) Enforcement of the health and nuisance standards list- ed by the Planning Commission in the June 28 communi- cation. 4. Kennels on which permits were improperly issued: ah im- proper permit is_no permit at all, and therefore these kennels will have to obtain a new Conditional Use Permit or (at the minimum) comply with the standards in effect at the time of their application. City Attorney Martin advised this is a continued hearing based on the Planning Commission recommendation originally made to the City Council, and the question is whether a Conditional Use Per- mit will be required. Mayor Tyrell declared the public hearing reopened, and asked if anyone wished to speak for or against the proposals at this time. No one came forward to speak. Councilman Merritt moved to close the public hearing, Councilman Clemson seconded and the motion 941 Council Minutes, August 16, 1966, Page 2 carried unanimously. City Attorney Martin advised the Planning Commission has report- ed to the City Council in compliance with Planning Law, and the Council is in concordance with the proposed changes. He . presented an Ordinance to be considered as an interim ordinance to replace the moratorium which expires on Sept. 30, 1966, and which would be an urgency ordinance and go into effect immediate- ly and would cover the conditional use requirements. He read title to Ordinance No. 66 -207 AN ORDINANCE OF THE CITY OF TEMPLE CITY SUSPENDING ORDINANCE NO. 66 -198 AND ENACTING AN INTERIM ZON- ING ORDINANCE, PURSUANT TO THE PROVISIONS OF SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE, RELATING TO THE CONSTRUCTION OF KEN - NELS, ANIMAL HOSPITALS, VETERINARY CLINICS AND OFFICES. Council- man Merritt moved to waive further reading of Ordinance No. 66- 207 and to adopt as an Urgency Ordinance, Councilman Clemson se- conded, and the motion was carried by the following called vote: AYES: Councilmen- Clemson, Harker, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilman - Beckley City Attorney Martin stated two permits were issued improperly and the Council should decide if they should be required to com- ply with conditional use permit requirement or to comply with con- ditions existing when permits were issued. Following discussion the Council felt they should be allowed to meet those requirement and without going to the conditional use per mit. City Attorney Martin read title to Ordinance No. 66 -206 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 1001 OF THE TEMPLE CITY ZONING CODE (Kennels). Councilman Merritt moved to waive further reading of Ordinance No. 66 -206, Councilman Harker seconded and the motion carried unanimously. No further action was taken as this was the first reading of the ordinance. UNFINISHED BUSINESS: 6. ORDINANCE NO. 66 -204: 1st read. re zone change Roseglen St., Lots 1 through 7, from M -1 and M -2 to R -1 -7200, City Attorney Martin presented Ordinance No. 66 -204 and read title AN ORDINANCE OF THE CITY OF TEMPLE CITY RECLASSIFYING CERTAIN PROPERTY (Roseglen Street). Councilman Clemson moved to waive further reading of Ordinance No. 66 -204, Councilman Merritt se- conded, and the motion carried unanimously. As this was the 1st reading of Ordinance No. 66 -204 no further action was taken. 7. ORDINANCE NO. 66 -205: Requiring conditional use permit for service stations and drive -in restaurant uses; 1st read. City Attorney Martin first presented Ordinance No. 66 -208 as an urgency ordinance to replace the moratorium on gasoline stations and drive -in restaurants which expires. on Sept. 30, 1966. Mr. Harrison of the Western 011 & Gas Assn. spoke in 'opposition to extending the moratorium and requesting the matter be sent back to the Planning Commission for establishing standards for development of service stations in Temple City. He was advised the Planning Commission would be working on this within the next two weeks, and the Mayor advised Mr. Harrison to direct his ac- tivities toward the Planning Commission re these standards, and the City Attorney advised this Ordinance No. 66 -208 was only an interim ordinance for 90 days to replace the moratorium. He then read title to Ordinance No. 66 -208 AN ORDINANCE OF THE CITY OF TEMPLE CITY SUSPENDING ORDINANCE NO. 66 -183 AND ENACTING AN INTER. IM ZONING ORDINANCE, PURSUANT TO THE PROVISIONS OF SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE, RELATING TO THE CONSTRUCTION OF SERVICE STATIONS AND DRIVE -IN RESTAURANTS WITHIN THE CITY. Councilman Clemson moved to waive further reading and to adopt Ordinance No. 66 -208 as an urgency ordinance, Councilman Merritt seconded, and the motion was carried by the following called vote. AYES: Councilmen - Clemson, Harker, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilman - Beckley City Attorney Martin then read title to Ordinance No. 66 -205 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 801 AND 901 OF THE TEMPLE CITY ZONING CODE RELATING TO SERVICE STATIONS AND DRIVE -IN RESTAURANTS. Councilman Harker moved to waive fur- ther reading, Councilman Merritt seconded, and the motion carried unanimously. SET PUBLIC HEARINGS: FOR 30 DAY EXTENSION OF MORATORIUMS ON KEN- NELS AND GASOLINE STATIONS AND DRIVE -IN RESTAURANTS: City Attorney Martin advised this agenda item was superseded by adoption of Ordinances No. 66 -207 and No. 66 -208. 9. REPORT ON REQUEST OF MCDONALDS DRIVE -IN: City Attorney Martin advised Mr. Gurney of the McDonald Drive -In had requested of the City Council permission to use the sidewalk at his place of business in conjunction with his drive -in restau- rant and place tables there. In his opinion to the Council he recommended the request be denied and the public streets be re- served for use of the public. Mr. Gurney spoke in support of his request. Following a lengthy discussion Councilman Harker moved to deny the request, Council- man Clemson seconded, and the motion carried unanimously. 10. REPORT RE CO- HOSTING CONTRACT CITIES ASSN. WITH CITY OF ROSEMEAD: City Manager Koski advised he contacted Rosemead and they have agreed to co -host the January meeting with Temple City and arrange ments are now being made. Councilman Harker moved to approve, Councilman Merritt seconded, and the motion carried unanimously. NEW BUSINESS: 11. RESOLUTION NO. 66 -642: re special election Annexation #11 City Manager Koski read title to Resolution No. 66 -642 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO. PERMIT THE REGISTRAR OF VOTERS OF SAID COUNTY TO RENDER SPECIFIED SER- VICES TO THE CITY OF TEMPLE CITY, RELATING TO THE CONDUCT OF A SPECIAL ELECTION TO BE HELD BY SAID CITY ON SEPTEMBER 13, 1966. Councilman Harker moved to adopt Resolution No. 66 -642, Council- man Clemson seconded, and the motion carried unanimously. 12. Council- man Clemson moved to adopt Resolution No. 66 -644, Councilman Merritt seconded, and the motion carried unanimously. 14. RESOLUTION NO. 66 -645: establishing polling places and appointing election boards for Annexation #12 City Manager Koski read title to Resolution No. 66 -645 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY PERTAINING TO THE SPECIAL ELECTION TO BE HELD SEPTEMBER 1.3, 1966, RE ANNEXATION OF "ANNEXATION NO. 12" TO THE CITY OF TEMPLE CITY. Councilman Merritt moved to adopt Resolution No. 66 -645, Councilman Clemson seconded and the motion was unanimously carried. 15. RESOLUTION NO. 66 -646: ordering canvass of the special elections on the 13th day of Sept., 1966, to be made by the City Clerk. City Manager Koski read title to Resolution No. 66 -646 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ORDERING THE CANVASS OF THE SPECIAL ELECTIONS TO BE HELD ON THE 13TH DAY OF SEPTEMBER, 1966, TO BE MADE BY THE CITY CLERK OF THE CITY OF TEMPLE CITY. Councilman Harker moved to adopt Resolution No. 66 -646, Councilman Merritt seconded, and the motion was unan- imously carried. 943 Council Minutes, August 16, 1966, page 4 16. APPOINTMENT OF PERSONNEL: a. City Manager Koski presented Resolution No. 66 -647 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TROY E. JEFFRIES AS PARK MAINTENANCE MAN. Councilman Merritt moved to adopt Resolution No. 66 -647, Councilman Clemson second- ed and the motion was unanimously carried. b. City Manager Koski presented Resolution No. 66 -651 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING DAVID RECUPERO AS ASSISTANT TO THE CITY MANAGER. Councilman Clemson moved to adopt Resolution No. 66 -651, Councilman Harker seconded, and the motion carried unanimously. c. City Manager Koski presented Resolution No. 66 -652 A RESOLU- TION OF THE CITY OF TEMPLE CITY APPOINTING EDWARD MARTIN AS ADMINISTRATIVE ASSISTANT. Councilman Clemson moved to adopt Re- solution No. 66 -652, Councilman Harker seconded, and the motion carried unanimously. 17. PLANNING COMMISSION RECOMMENDATIONS: a. Re Clarification of R -2 Zone. Councilman Harker moved to set a public hearing on Sept. 6, 1966, at 7:30 P. M., Councilman Merritt seconded, and the motion carried unanimously. 18. PARKS & RECREATION COMMISSION RECOMMENDATIONS: a. Recommend recreation facilities at Live Oak Park, both indoor and outdoor be made available to organized Temple City Youth groups for overnight use. Planning Director Kobett presented the above recommendation and following discussion was referred back to the Commission for development of rules and regulations to cover this use prior to Council consideration. b. Recommend approval of use of building complex at Live Oak Park overnight by Temple City by Temple City Rainbow Girls on a date approved by the Recreation Dept. and subject to follow- ing rules and regulations: (1) at least one male adult on duty at all times, and he must be husband of one of women - supervisors present, (2) at least one mother for every ten girls in attendance present at all times, (3) adult group leader must notify T. C. Sheriffs Dept. of intended overnight use, (4) responsible supervising adult will be issued park key and no member of using group or the group itself is to leave buildings between hours of 8 :00 P.M. and 8 :30 A.M. ex- cept for emergency reasons, or when released by authorized Recreation Dept. staff, (5) standard $3.00 pr. hour special coverage fee to cover services of checking in and out. These rules and regulations designed for above use and subject to change pending adoption of standard policy covering over -night use of City recreation facilities. Recreation Director Kobett presented the above recommendation. Following considerable discussion it was agreed that under rule (3) that the Recreation Director also contact the Sheriffs Dept. regarding the over -night usage. Sgt. Cavalero of the Sheriffs Dept. advised there would be no problems as far as the Sheriffs coverage was concerned. Councilman Clemson moved to approve re- commendation "b" of the Commission, Councilman Merritt seconded, and the motion was carried unanimously. 19. RESOLUTION NO. 66 -648: calling for bids on bonds, Parking Dist.4. City Manager Koski presented Resolution No. 66 -648 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, CALL- ING FOR SEALED BIDS ON BONDS TO BE ISSUED TO REPRESENT UNPAID ASSESSMENTS UPON LANDS IN VEHICLE PARKING DISTRICT NO. 4 OF SAID CITY. Councilman Merritt moved to adopt Resolution No. 66 -648, Councilman Harker seconded, and the motion carried unanimously. 20. Temple Shopping Center Assn.: request for restricted park- ing north and south side of Las Tunas Dr. between Primrose and Camellia on Friday, Aug. 19, 1966, between hours of 9:00 A.M. and 5:30 P.M. for sidewalk sale. Also permission to hang five banners on overhead lines on Las Tunas at Rosemead, Primrose, Kauffman, east side of Temple City Blvd. and at Temple City Blvd. north of Las Tunas. Public Works Director Pizzorno presented the recommendations of the Traffic Commission. Councilman Merritt moved to approve items 6, 7 and 9, Councilman Clemson seconded, and the motion carried unanimously. Under item 10 the Public Works Director advised the City could do this with an encroachment permit and the City requests the Division of Highways to put the markings on the Highway. Council- man Clemson moved to approve item 10 subject to obtaining the encroachment, Councilman Merritt seconded, and the motion carried unanimously. Under item 12 following discussion Councilman Merritt moved to approve item 12 subject to liability insurance requirements on the banners, Councilman Clemson seconded and the motion carried unanimously. Item 13. The Commission recommends the Council request support and endorsement of League of Calif. Cities in passage of effective vehicle noise legislation, and that this be placed on the Agenda of the 68th Annual Conference of the League in San Diego. Councilman Merritt moved to support and endorse this recommenda- tion and that it be conveyed to the League conference, Councilman Clemson seconded, and the motion carried unanimously. The City Manager presented a letter from Donald L. Clark, 10214 La Rosa Dr. concerning the noise of motorcycles and scooters in that neighborhood. Councilman Merritt moved to answer the letter and indicate our support, Councilman Clemson seconded, and the motion was unanimously carried. 21. GROUND MAINTENANCE AGREEMENT: 1966 -67 COUNTY LIBRARY Councilman Clemson moved to authorize the Mayor and City Clerk to sign the ground maintenance Agreement on behalf of the City re the County Library, for 1966 -67, Councilman Harker seconded, and the motion was unanimously carried. 22. SET PUBLIC HEARING: CH. 27 ASSESSMENT SPREAD, CURB & GUTTER, Broadway, south side 9200 -9400 block Public Works Director Pizzorno presented the above request. Coun- cilman Clemson moved to set the public hearing for Sept. 6, 1966, at 7:30 P. M., Councilman Merritt seconded, and the motion was carried unanimously. 23. PARKING DISTRICTS NO. 1 and No. 4: awarding demolition contract for building and removal Ray Lewis, of Krelle & Lewis, advised three bids were received for building demolition and removal of the house and apartments and for the Stake office, the lowest bidder being Ababa Demoli- tion Engineers for a total of $2335. which they considered a reasonable bid. Councilman Clemson moved to approve the sum of $1790. for Parking Dist. #4 and $545. for Parking Dist. :f, a tots' of $2335. and to award the contract to the low bidder Ababa De- molition Engineers, Councilman Merritt seconded, and the motion carried unanimously. 24. APPROVAL OF PLANS & SPECIFICATIONS, CONSTRUCTION OF IMPROVEMENTS PARKING DISTRICTS NO. 1, NO. 3, AND NO. 4, Ray Lewis of Krelle & Lewis presented the plans and specifica- tions for the above improvements involving four schedules, (1) clearing and grubbing, (2) construction of masonry block walls and black top, (3) sprinkling and lighting systems, and (4) landscaping. There are two drinking fountaitins for each mall and two more storage bins as recommended by the Parking Commission Councilman Clemson moved to approve the plans and specifications, Councilman Merritt seconded, and the motion was unanimously carried. 945 1 Council Minutes, August 16, 1966, page 6 The schedule is to receive bids Sept. 19, start work Oct. 1, and the parking facilities to be ready on Nov. 15 and the land- scaping to be completed by Nov. 28. A discussion followed concerning the malls which will not be completed as planned due to lack of cooperation of the merchants in waiving ingress and egress rights if the alley were converted into a mall. Disappointment was expressed by the Council that the complete installation of mall and parking district could not be completed as planned, which would be at no additional expense to the property owner as the City would be installing the mall to replace the existing alleys. 25. RESOLUTION NO. 66- 650: Granting consent and jurisdiction to Los Angeles County for annexation to Longden Lighting District. Public Works Director Pizzorno advised a petition was circulated for this annexation covering the southwest corner of Freer and Halifax. The County deals with people directly and this is a standard procedure. Councilman Clemson moved to adopt Resolution No. 66 -650, Councilman Harker seconded, and the motion was un- animously carried. 26. RESOLUTION NO. 66 -649: Warrants & Demands City Manager Koski presented Resolution No. 66 -649 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $44,347.88, DEMAND NOS. 8609 THROUGH 8676. Councilman Clemson moved to adopt Resolution No. 66 -649, Councilman Merritt seconded, and the motion carried unanimously. 27. SET PUBLIC HEARING: CURB & GUTTER, Lower Azusa, south side, . Fiesta to alley west of Temple City Blvd. Public Works Director Pizzorno presented the above petition and requested the matter be set for public hearing. Councilman Harker moved to set this for public hearing on Sept. 6, 1966, at 7:30 P. M., Councilman Merritt seconded, and the motion was unanimously carried. 28. COMMUNICATIONS: City Manager Koski presented a letter from Mr. & Mrs. Fickes, 6258 Hart Ave., requesting reconsideration by the Council of their variance request, which was denied at a public hearing on June 8, 1966. Mayor Tyrell called upon the City Attorney to express the options that are available to the Council. City Attorney Martin stated in connection with the application for reconsideration his opinion was the application must be denied, that there is no reconsideration of an action finally concluded. There is a one year waiting period and then the re- quest must be reprocessed by the Planning Commission and City Council in accordance with the Code. If the plans were sub- stantially changed they could reapply prior to the year waiting period, or the Planning Commission could initiate a variance based on a precise plan which would be a cul de sac. Planning Director Dragicevich saidchat he had talked with the applicants and they are willing to submit a new plan but not substantially different, which would be four lots with a 22 ft. street which is way substandard and the City cannot accept substandard streets He also advised another avenue open to them would be a lot split procedure with a private driveway 30 ft. wide. However their application was for a 20 ft. driveway. Following discussion Councilman Clemson moved the staff work with the Fickes' and that the fee be waived for reconsideration by the Planning Commission, Councilman Harker seconded, and the motion was carried unanimously. 29. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: At this time Mayor Tyrell invited David Day to the podium who as a Life Scout was there as a prerequisite for the merit badge of Eagle. He was welcomed and commended upon his achievements. 29. MATTERS FROM CITY OFFICIALS: Public Works Director Pizzorno presented a letter from the Leagu: requesting a proclamation of "National Highway ',^leek" and read title to Resolution No, 66 -653 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ENDORSING NATIONAL HIGHWAY WEEK. Councilman Clemson moved to adopt Resolution No. 66 -653, Council- man Merritt seconded, and the motion carried unanimously. 946 Council Minutes, August 16, 1966, page 7 City Manager Koski advised the Council that a legal description had been incorrectly noted on a lien for a curb and gutter pro- ject and was so filed by the City. Subsequently buyers of the property by the name of Swinehart purchased the property and received the tax bill with the assessment on it. The City Attorney advised the City should repay the assessment to the Swineharts and proceed to collect from the previous owners, in the amount of $180. Councilman Clemson moved to reimburse the Swineharts on condition of getting an assignment and to recover the amount from the sellers, the Oleas', Councilman Harker seconded, and the motion was unanimously carried. The City will make the check out in the sum of the assessment on their tax bill and the City Attorney will prepare the appro- priate assignment so the City can collect from the previous owners. The Chief Deputy City Clerk requested authorization for drawing warrants for registration and room deposit for the forthcoming League of California Cities conference in San Diego, the amount to be determined as soon as attendance is confirmed. Council- man Merritt moved to approve, Councilman Clemson seconded, and the motion carried unanimously. The Chief Deputy City Clerk also requested authorization for a warrant to be drawn payable to the Postmaster to cover the costs of mailing the sample ballots in the forthcoming special elections on Sept. 13, 1966, for Annexation #11 and Annexation #12, the amount to be determined when they are ready for mailing. Councilman Harker moved to authorize this warrant, Councilman Merritt seconded, and the motion carried unanimously. City Manager Koski advised that he would be on his vacation from Aug. 22 through the 26th of August with Council approval. Councilman Clemson asked about the available position for steno and the City Manager advised it was difficult finding a qualified person. Councilman Merritt stated he was not quite as disappointed as some of the Councilmen re the parking districts but felt a start was being made and he believed the others will see the error of their way and follow suit in completing other areas. Public ':Works Director Pizzorno stated the house on the southeas: corner of Baldwin and Daines should be declared surplus prop- erty and disposition ordered. A mover estimated $1800. to raise the house up and $600. to move three miles, and a total of about $8000. to put the house in shape, or he would purchase it for about $1000. and take it out. The City Manager re- commended it be declared surplus and authorize the staff to negotiate the best possible disposal. Councilman Merritt so moved, Councilman Clemson seconded, and the motion carried unanimously. 31.
