RESOLUTION NO. 2011-054 ADOPTED May 10, 2011
A RESOLUTION: AUTHORIZING AN AGREEMENT, APPROVING WATER AND
SEWER EXTENSION PERMITS, WAIVING A PERFORMANCE
GUARANTEE, AND ACCEPTING A CASH PAYMENT IN LIEU OF
CONSTRUCTION OF SMALL SECTIONS OF SIDEWALK FOR
FREDERICK DOUGLASS ELEMENTARY SCHOOL ES -15 (LMIS-
TLPF- 2010 -0006)
WHEREAS, the construction drawings and final site plan for Frederick Douglass
Elementary School ES -15, to be constructed by the Loudoun County Public Schools, are in an
approval form; and
WHEREAS, the cost estimate for public improvements of $2,121,000 is approved by the
Director of Plan Review; and
WHEREAS, it is in the public interest to waive the costs associated with a performance
guarantee for the necessary public improvements; and
WHEREAS, the Director of Public Works recommends approval of a contract for
installation of public improvements and waiving the performance guarantee for Frederick
Douglass Elementary School ES -15; and
WHEREAS, the Director of Public Works also recommends acceptance of a cash
payment in lieu of construction of small sections of sidewalk for Frederick Douglass Elementary
School ES -15.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The Town Manager shall execute the contract for public improvements in a
form approved by the Town Attorney with the Loudoun County Public Schools for the

FREDERICK DOUGLASS ELEMENTARY SCHOOL ES -15 (LMIS-
TLPF- 2010 -0006)
improvements shown on the plans ready for approval by the Director of Plan Review for
Frederick Douglass Elementary School ES -15.
SECTION II. The extension of municipal water and sewer for Frederick Douglass
Elementary School ES -15 is approved in accordance with Section 34 -123 and 35 -25 of the Town
Code.
SECTION III. The performance guarantee for the public improvements in the amount of
$2,121,000 is waived, conditioned on the requirement that occupancy of the facility shall not be
permitted until the public improvements are completed to the satisfaction of the Town, or a
subsequent performance guarantee is furnished in an amount approved by the Director of Public
Works for outstanding punchlist items.
SECTION IV. The Town Council hereby accepts a cash payment of $4,600 in lieu of
construction of small sections of sidewalk for Frederick Douglass Elementary School ES -15
SECTION V. The $4,600 shall be held by the Town to be used for the construction of
small sections of sidewalk by the Town or other parties as authorized by the Town.
