RESOLUTION NO. 2011-055 ADOPTED May 10, 2011
A RESOLUTION: APPROVING CHANGE ORDER NO. 3 FOR THE DESIGN AND
ENGINEERING SERVICES ON THE OLD WATERFORD ROAD
SIDEWALK PROJECT IN THE TOTAL AMOUNT OF $5,549.00.
WHEREAS, the original design and engineering contract to improve Old Waterford Road
was awarded to RK &K in the amount of $67,949.50; and
WHEREAS, Change Order No. 3 is necessary to address the plats needed for acquisition of
easements and right -of -way on adjacent properties; and
WHEREAS, the Town needs to acquire right -of -way and easements; and
WHEREAS, Change Order No. 3 is in the amount of $5,549.00; and
WHEREAS, the contractual increase by Change Order No. 3 causes the contract amount to
be exceeded by the greater of 25% or $50,000; and
WHEREAS, the Virginia Public Procurement Act and the Capital Improvements Policies
and Procedures Manual requires that change orders that cause the contract to be exceeded by the
greater of 25% or $50,000 be approved by Town Council; and
WHEREAS, the Old Waterford Road Sidewalk project has sufficient funds in the budget to
cover the associated costs; and
WHEREAS, the Director of Capital Projects recommends approval of this change order.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. Change Order No. 3 in the amount of $5,549.00 is hereby approved.

SECTION II. The Town Manager is authorized to execute Change Order No. 3 to the
design and engineering contract with RK &K for the Old Waterford Road Sidewalk Project in the
total amount of $5,549.00.
