HomeMy Public PortalAbout2011_05_10_R057 Initiating Amendments to the TC for 2011 General AssemblyThe Town of Leesburg, Virgini RESOLUTION NO. 2011 -057 PRESENTED May 10, 2011 ADOPTED May 10, 2011 A RESOLUTION: INITIATING AMENDMENTS TO THE TOWN CODE TO ADDRESS CHANGES IN STATE LAW ENACTED DURING THE 2011 SESSION OF THE VIRGINIA GENERAL ASSEMBLY WHEREAS, certain bills passed during the 2011 session of the Virginia General Assembly require amendments to the Town Code in order for the Town to remain compliant with state law; and WHEREAS, the first of these bills is House Bill 2364 which allows a locality to authorize its chief administrative officer to provide aid to or accept aid from other localities; and WHEREAS, the second bill is House Bill 2142 which raises the fee a locality may charge for the passing of a bad check from $35 to $50; and WHEREAS, the third bill is House Bill 2019 which allows the treasurer of any county and the treasurers of the towns within the county to enter into reciprocal agreements to collect each other's local real and personal property taxes; and WHEREAS, the fourth bill is House Bill 1645 which codifies the November 2010 constitutional amendment that provides for a property tax exemption for veterans who have a 100 percent service- related disability; and WHEREAS, the fifth bill is House Bill 2297 which requires localities to give utility customers a 30 -day written notice prior to terminating water services; and WHEREAS, the sixth bill is Senate Bill 1216 which requires localities to provide property owners with 30 days' written notification prior to recording a lien on the property for a tenant's unpaid water or sewer fees; and A RESOLUTION: INITIATING AMENDMENTS TO THE TOWN CODE TO ADDRESS CHANGES IN STATE LAW ENACTED DURING THE 2011 SESSION OF THE VIRGINIA GENERAL ASSEMBLY WHEREAS, the last of these bills is Senate Bill 757 which requires that any ordinance which prohibits the shooting of pneumatic guns in certain areas shall have an exception to allow the firearms to be discharged on private property with permission of the owner when such discharge is conducted with reasonable care to prevent a projectile from crossing the bounds of said private property; and WHEREAS, the Town Code Article II, Section 26 -24; Prohibited Uses in Public Parks; Hunting and Firearms, needs to be amended to conform to the Code of Virginia. THEREFORE RESOLVED, the Council of the Town of Leesburg in Virginia directs the Town Attorney to prepare a draft ordinance to amend the appropriate chapters of the Town Code to address the changes in state law enacted by House Bills 2364, 2142, 2019, 1645 and 2297 and Senate Bills 1216 and 757 of the 2011 session of the Virginia General Assembly and to comply with the Code of Virginia.
