RESOLUTION NO. 2011 -066 ADOPTED May 24, 2011
A RESOLUTION: AUTHORIZING THE TOWN MANAGER TO EXECUTE A RENEWAL
OF LICENSE AGREEMENT BETWEEN THE TOWN OF LEESBURG
AND AT &T CORPORATION
WHEREAS, the current License Agreement between the Town of Leesburg, Virginia
"Town and AT &T Corporation "AT &T expired in June of 2010; and
WHEREAS, AT &T currently owns and operates fiber optic cable within the Town's right-
of-way; and
WHEREAS, AT &T requests to continue to own and operate its fiber optic cable within the
Town's right -of -way; and
WHEREAS, on September 28, 2010, the Town Council authorized the Town Manager to
approve a License Agreement with AT however, this License Agreement was further negotiated
and changed by the parties; and
WHEREAS, the Town Attorney and the Director of Public Works have negotiated a renewal
of the current License Agreement with AT &T and the terms contained in the current Renewal of
License Agreement are reasonable and equitable and will benefit the Town and the citizens of
Leesburg; and
WHEREAS, the Town Attorney has approved the Renewal of License Agreement between
the Town and AT &T.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that the
Town Manager shall execute the Renewal of License Agreement with AT &T Corporation dated
May of 2011.
RESOLUTION:
