A RESOLUTION: AWARDING THE 2011 ANNUAL STREET MILLING AND
RESURFACING CONSTRUCTION CONTRACT
WHEREAS, the current renewable annual contract for milling and resurfacing is in its final
year with the current contractor; and
WHEREAS, the total amount that will be spent on this contract in any one year will vary
and will depend on the budgeted amount for that year; and
WHEREAS, in response to a public solicitation for the construction bids for this Street
Milling and Resurfacing Contract, the town received four bids on May 19, 2011 from the following
firms:
WHEREAS, this is a unit price contract; and
WHEREAS, the quantities used for bid comparison are estimates; and
WHEREAS, the contract will be awarded based on the low bid of $666,367.78, which is
based on the unit prices bid times the quantities included in the bid documents; and
WHEREAS, the actual paving and milling quantities for FY2012 will be based on the unit
prices in the low bid and the Town Council approved $750,000 for milling and paving in the
adopted FY2012 budget; and
WHEREAS, the bids were evaluated by the Deputy Director of the Department of Capital
Projects and the Chief Purchasing Officer in accordance with the Town's Purchasing Policy; and

WHEREAS, Francis O. Day Company, Inc. of Rockville, MD was determined to be the
lowest responsive and responsible bidder; and
WHEREAS, this contract will be for an initial period of one year and renewable up to four
additional consecutive one -year periods.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The 2011 Milling and Resurfacing Construction Contract is hereby awarded
to Francis O. Day Company, Inc.
SECTION II. The Town Manager is authorized to execute this contract.
