WHEREAS, a special exception application for an extended family residence has been filed by Bart and Beth Theriot, and is referred to as TLSE- 2011 -0001 Theriot; and WHEREAS, the subject property is located at 114 Morven Park Road, N.W., and is further described as Loudoun County Parcel Identification Number (PIN) 230 -16 -1972; and WHEREAS, the property is zoned R -4, Single Family Residential District; and WHEREAS, the Planning Commission held a Public Hearing on June 2, 2011; and WHEREAS, at their regular meeting of June 2, 2011 the Planning Commission recommended conditional approval of this application to the Town Council; and WHEREAS, Staff recommends approval subject to the conditions set forth below; and WHEREAS, Town Council has determined the proposed use meets the special exception standards for an extended family residence as set forth in the Zoning Ordinance Section 9.3.11; and WHEREAS, Town Council has determined that the Approval Criteria of Zoning Ordinance Section 3.4.12 have been satisfied; and WHEREAS, Town Council has determined that the proposal would serve the public necessity, convenience, general welfare and good zoning practice. THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia as follows: SECTION I: Special Exception application TLSE- 2011 -0001 Theriot is hereby approved to permit an extended family residence on the property at 116 Morven Park Road, N.W., further identified as Loudoun County Parcel Identification (PIN) number 230 -16 -1972, subject to the A RESOLUTION: APPROVING TLSE- 2011 -0001 THERIOT TO PERMIT AN EXTENDED FAMILY RESIDENCE AT 114 MORVEN PARK ROAD, N.W. following conditions: 1. Substantial Conformance: Development of this special exception use shall be in substantial conformance with the Special Exception Plat entitled "Special Exception Plat 114 Morven Park Road, N.W. Theriot Property" Sheet 1 of 1, dated February, 2011 and prepared by Stantec Consulting Services, Inc. 2. No Expressed or Implied Waivers: Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents. 3. Elevations: The extended family residence shall be constructed in general conformance with the elevations entitled "Guest House, Larry Theriot" dated 04/05/11 and prepared by Short Hill Design Construction, Ltd. including the sheets showing the "Guest House Elevations "Cottage Front/Left", "Cottage Front/Right and "Cottage Rear /Right 4. Extended Family Residence Use Limitations: a. Area Limitation. The extended family residence shall not exceed a maximum of twelve hundred (1,200) square feet. b. Main Residence Occupancy. The extended family residence shall only be valid when the main residence is owner occupied. c. Location. The extended family residence shall be a separate structure that conforms to all applicable zoning requirements as shown on the Special Exception Plat. The extended family residence shall not be separately metered for electricity or water. d. Occupancy Limitation. The occupants of the extended family residence shall be limited to Larry and Beth Theriot who are related to the main residence occupants by blood and marriage. e. Temporary Need. At no time may the number of occupants of the extended family residence exceed two (2). f. 2 Acknowledgement of Understanding. The owners of the single family dwelling shall certify their understanding that an extended family residence is limited by the conditions presented in the special exception approval letter, including: number of occupants, who the occupant(s) will be, the relation of the occupant(s) to the main resident(s), and the location and size of the extended family residence. This certification shall be attached to the approval letter as an exhibit. g. Annual Staff Review.
