HomeMy Public PortalAbout2011_06_28_R084 Reciprocal Agreement with LC for PP TaxThe Town of Leesburg, �Ji�rginia RESOLUTION NO. 2011 -084 ADOPTED June 28, 2011 A RESOLUTION: AUTHORIZING THE DIRECTOR OF FINANCE TO ENTER INTO A RECIPROCAL AGREEMENT WITH THE COUNTY TREASURER TO COLLECT CERTAIN REAL AND PERSONAL PROPERTY TAXES WHEREAS, the Virginia General Assembly has enacted an amendment to Va. Code 58.1 -3910, which authorizes a county treasurer and the treasurer (or other duly authorized officer or employee) of any town located within such county to enter into a reciprocal agreement with the approval of their respective governing bodies, that provides for the town treasurer to collect real and personal property taxes owed to the county, and for the county treasurer to collect real and personal property taxes owed to the town; and WHEREAS, the Loudoun County Treasurer and the Director of Finance of the Town of Leesburg, with the approval of their respective governing bodies, desire to enter into a reciprocal agreement, implementing the authority granted by Va. Code 58.1 -3910, as amended; THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the Director of Finance is authorized to enter into a reciprocal agreement with the Loudoun County Treasurer for the collection of real and personal property taxes. Roger Zurn, Jr., Treasurer of Loudoun County, Virginia (the "Treasurer and Norm Butts, Director of Finance for the Town of Leesburg, Virginia (the "Director of Finance (collectively, the "Parties" and individually, each a "Party with the approval of their respective governing bodies. RECITALS WHEREAS, the Virginia General Assembly has enacted an amendment to Va. Code 58.1 -3910, which authorizes a county treasurer and the treasurer (or other duly authorized officer or employee) of any town located within such county to enter into a reciprocal agreement, with the approval of their respective governing bodies, that provides for the town treasurer to collect real and personal property taxes owed to the county, and for the county treasurer to collect real and personal property taxes owed to the town, see Va. Acts of Assembly 2011 c.431 c. 475; and WHEREAS, the Parties, with the approval of their respective governing bodies, desire to enter into this Agreement, implementing the authority granted by Va. Code §58.1 -3910, as amended; NOW, THEREFORE, the Parties agree as follows: 1. Effective Date. This Agreement shall become effective on the first date by which it has been executed by all Parties as set forth below, or on July 1, 2011, whichever is later (the "Effective Date Each Party shall obtain the approval of its respective governing body prior to executing the Agreement. 2. Guidelines for Payments. The Parties shall develop and agree upon a set written of guidelines and procedures for the efficient implementation and administration of this Agreement (the "Guidelines The Parties, in their discretion, may modify the Guidelines from time -to -time, by mutual consent, as they deem necessary to promote the purposes of this Agreement. 3. Reciprocal Agreement. The Treasurer hereby agrees to accept payment of real and personal property taxes owed to the Town of Leesburg (the "Town and the Director of Finance hereby agrees to accept payment of real and personal property taxes owed to the County of Loudoun (the "County Each Party shall receive real and personal property tax payments on behalf of, and transmit such payments to the other Party, in accordance with procedures set forth in the Guidelines. All payments shall be transmitted to the appropriate Party within two business days after receipt, or within such other time as may be set forth in the Guidelines. 4. Binding Effect. This Agreement is binding upon, and shall inure to the benefit of the Parties and their respective successors, agents and representatives. Specifically, this Reciprocal Agreement for Collection of Real and Personal Property Taxes Page 2 Agreement shall be binding upon the current and any future Treasurer of the County and on the current and any future Director of Finance for the Town, unless and until the Agreement is modified or terminated in accordance with Paragraphs 5 and 6 below, respectively. 5. Amendments and Modifications. This Agreement may be amended at any time, by written instrument executed by the Parties, with the approval of their respective governing bodies. A formal written agreement, approved by the Parties' respective governing bodies, shall not be required to modify the Guidelines. The Guidelines may be modified by mutual assent of the Parties, as confirmed in writing. 6. Termination: (a) Either Party shall have the right to terminate this Agreement upon 60 days' written notice to the other Party. Notice of termination shall be delivered to the County Treasurer or the Town Director of Finance in office as of the date of such notice. (b) Notwithstanding the provisions of subparagraph (a) above, this Agreement shall automatically terminate upon the enactment of any bill or other law that renders this Agreement invalid or otherwise contrary to law.
