RESOLUTION OPPOSING PROPOSED LAND USE REGULATORY
REFORM ACT
WHEREAS, the Borough Council of the Borough of Carteret has been advised that
the current administration in Trenton is considering a revision to the Municipal Land
Use Law in the form ora so-called "Land Use Regulatory Reform Act"; AND
WHEREAS, the proposal, as backed by builder-oriented groups, will shift land use
controls from local Planning Boards and elected officials to a "Land Use Review
Official", who is licensed by the New Jersey Department of Community Affairs; and
WHEREAS, said proposal would not only limit citizen objections, but also severely
deter and limit any effective appeal process; and
WHEREAS, said proposal will virtually eliminate municipal oversight and public
input;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the
Borough of Carteret that the Borough Council does hereby express its opposition to
the proposed Land Use Regulatory Reform Act in that it will silence citizen
participation, deprive local Planning and Zoning Boards of their full participation in
developmental applications, create additional central bureaucracy and limit appeals
only to those who can post $5,000.00 bonds, thereby failing to provide for the best
interests of the citizens of the Borough of Carteret; and
BE IT FURTHER RESOLVED that copies of this Resolution be sent to Governor
Christine Todd Whitman, the P[esident of the New Jersey State Senate, the Speaker
of the New Jersey Assembly, each member of the Middlesex County legislative
delegation, and to each Middlesex County Municipality.
Adopted this 7th day of March, 1996
and certified as a true copy of the original
on March 8, 1996.
