HomeMy Public PortalAbout2011_09_27_R117 Settlement Agreement for RPZ Land AcquisitionThe Town of Leesburg, Virginia PRESENTED September 27, 2011 RESOLUTION NO. 2011 -117 ADOPTED September 27, 2011 A RESOLUTION: AUTHORIZING A SETTLEMENT AGREEMENT FOR THE PURCHASE OF LAND FOR THE RUNWAY 17 NORTH RUNWAY PROTECTION ZONE (RPZ); ADDING A PROJECT TO THE FY 2012- 2017 CIP FOR THE LAND ACQUISITION; AND APPROPRIATING $250,000 FOR THE PROJECT IN FY 2012. WHEREAS, the land acquisition for the Runway 17 North Runway Protection Zone (RPZ) was originally in the FY 2008 CIP; and WHEREAS, the Federal Aviation Administration (FAA) requires that all sponsor airports have control, via fee simple purchase and/or avigational easements for the associated Runway Protection Zones; and WHEREAS, the Runway 17 North RPZ was identified in the approved Airport Master Plan and Airport Layout Plan; and WHEREAS, the FAA conditionally approved the Airport Layout Plan pending the acquisition of all land associated with the RPZ; and WHEREAS, a negotiated settlement has been reached with the land owner; and WHEREAS, the total cost of this project is $313,689; and WHEREAS, the cost of the settlement agreement and consultant fees for FY 2012 is $250,000; and WHEREAS, the FAA will cover 95% or $237,500 and the Virginia Department of Aviation (DOAV) will cover 3% or $7,500 of the costs associated with the project; and WHEREAS, the Town's share of the settlement is 2% or $5,000, which will result in the use of an additional $5,000 in Town bond funds for the current CIP; and A RESOLUTION: AUTHORIZING A SETTLEMENT AGREEMENT FOR THE PURCHASE OF LAND FOR THE RUNAWY 17 NORTH RUNWAY PROTECTION ZONE (RPZ); ADDING A PROJECT TO THE FY 2012- 2017 CIP FOR THE LAND ACQUISITION; AND APPROPRIATING $250,000 FOR THE PROJECT IN FY 2012. WHEREAS, the land acquisition must be added to the FY 2012 FY 2017 CIP and the funding appropriated to the FY 2012 CIP; and WHEREAS, the Town Council must authorize the settlement agreement. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that: SECTION I: The Town Attorney and staff are authorized to enter into a settlement agreement with the land owner as required for fee simple purchase of land and avigational easements. SECTION II: The Town Manager is authorized to execute any and all paperwork associated with this land purchase in a contract form approved by the Town Attorney. SECTION III: The Land Acquisition North Runway RPZ is added to the current FY 2012 FY 2017 CIP. SECTION IV: The funding necessary for this project is hereby appropriated in the following amounts: FAA at 95% or $237,500; DOAV at 3% or $7,500; and Town funds at 2% or $5,000 of bond funding.
