A RESOLUTION: PRESENTED: September 27, 2011 2011 -118 ADOPTED: September 27, 2011 INITIATING AMENDMENTS TO SECTION 3 OF THE LEESBURG SUBDIVISION AND LAND DEVELOPMENT REGULATIONS TO MAKE CHANGES NECESSARY TO MAKE MINOR CHANGES TO THE TYPE OF LAND DEVELOPMENT APPLICATION REQUIRED FOR VARIOUS TYPES OF "RESIDENTIAL" APPLICATIONS TO MAKE THE FEE AND PLAN TYPE MORE COMMENSURATE WITH THE ACTUAL SUBMISSION REQUIREMENTS. WHEREAS, the Department of Plan Review has recognized that when the SLDR was last revised back in June of 2011, it was not anticipated that it would have such a financial burden on the average Home Owner wanting to build a garage, construct an addition onto their home, re -grade their lot or even add a shed to their yard; and WHEREAS, under the current regulations all of these scenarios would require a "Mini Site Plan" and require a $3,500 submission fee. In some cases the cost of the fee plus the cost of preparing a "Mini Site Plan" could become a substantial portion of the final actual costs associated with the residents proposed improvements; and WHEREAS, with the proposed changes, the plan type would be a "Site Plan Waiver" which gives more flexibility to the Director of Plan Review to define the absolute minimum plan information required, eliminates the need for a professional engineer to prepare the plan and permits the home owner or his contractor to prepare a much simpler and cost effective plan. The submission fee would also be more commensurate with the review at $500 per submission (anticipate a single submission). THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that: -2- A RESOLUTION: INITIATING AMENDMENTS TO SECTION 3 OF THE LEESBURG SUBDIVISION AND LAND DEVELOPMENT REGULATIONS TO MAKE CHANGES NECESSARY TO MAKE MINOR CHANGES TO THE TYPE OF LAND DEVELOPMENT APPLICATION REQUIRED FOR VARIOUS TYPES OF "RESIDENTIAL" APPLICATIONS TO MAKE THE FEE AND PLAN TYPE MORE COMMENSURATE WITH THE ACTUAL SUBMISSION REQUIREMENTS. SECTION 1. Amendments to the SLDR are hereby initiated and referred to the Planning Commission to make minor changes to implement the changes noted above. SECTION 2. The Planning Commission shall hold a public hearing to consider these amendments to the SLDR and report its recommendation to Town Council pursuant to Chapter 22, Title 15.2 -2204 of the 1950 Code of Virginia, as amended.
