HomeMy Public PortalAbout2011_09_27_R120 - Rescinding Authorization to Purchase 1 Country Club DriveThe Town of Leesburg, ?irginia PRESENTED: September 27, 2011 RESOLUTION NO. 2011-120 ADOPTED: September 27, 2011 A RESOLUTION: RESCINDING AUTHORIZATION FOR THE TOWN ATTORNEY TO ACQUIRE THE PROPERTYAND PARCEL AT 1 COUNTRY CLUB DRIVE IN ORDER TO DEVELOP THE LINDEN HILL ACCESS LANE TO COUNTRY CLUB DRIVE IN COORDINATION WITH THE SOUTH KING STREET WIDENING PROJECT WHEREAS, Town Council has an approved project to widen South King Street from Evergreen Mill Road to Greenway Drive as part of the Town's Fiscal Year 2012 -2017 Capital Improvement Program; and WHEREAS, Linden Hill residents requested the Town to maintain full access in/out of Linden Hill Way as part of the widening project; and WHEREAS, Town Council authorized a Capital Improvement Project in July 2010 for the design and construction of a one -way access lane from Linden Hill Way to Country Club Drive that included the acquisition of property at 1 Country Club Drive; and it is not the desire of the Town Council to remove the access lane project from the Capital Improvements Project; and WHEREAS, In December 2010, Town Council approved Town Resolution 2010 -156 that amended the Fiscal Year 2011 -15 Capital Improvement Program to provide $375,000 in funding to acquire the property and parcel at 1 Country Club Drive in order to develop the Linden Hill Access Lane; and the Town has worked diligently to acquire the property at 1 Country Club Drive since directed; and -2- A RESOLUTION: RESCINDING AUTHORIZATION FOR THE TOWN ATTORNEY TO ACQUIRE THE PROPERTYAND PARCEL AT 1 COUNTRY CLUB DRIVE IN ORDER TO DEVELOP THE LINDEN HILL ACCESS LANE TO COUNTRY CLUB DRIVE IN COORDINATION WITH THE SOUTH KING STREET WIDENING PROJECT WHEREAS, In July 2011, Town Council approved Motion 2011 -027 that authorized the Town Attorney to attend the auction of 1 Country Club Drive in order to develop the Linden Hill Access Lane; and WHEREAS, Due to the declining value of the property at 1 Country Club Drive since the Town Attorney was authorized in July 2011 to acquire the property at auction; and WHEREAS, purchasing the property at auction puts the Town at a significant financial disadvantage since the bid authorization is public; and WHEREAS, Town Council does not desire to be responsible for the significant costs of property management and maintenance issues related to 1 Country Club Drive or any renovation that may be required for a resale; and WHEREAS, The Town will allocate sufficient dollars to landscape the access road, if needed; and WHEREAS, If the Town needs to acquire Right of Way from 1 Country Club Drive at a later point, the acquisition will be facilitated by having a single, identifiable owner, or by other steps as needed; and WHEREAS, the Town is still in the process of designing the road as directed by the Town Council and no additional easements or right of way are needed to complete the design at this time. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the Town Council rescinds Motion 2011 -027 that authorizes the Town Attorney to participate in the -3- A RESOLUTION: RESCINDING AUTHORIZATION FOR THE TOWN ATTORNEY TO ACQUIRE THE PROPERTYAND PARCEL AT 1 COUNTRY CLUB DRIVE IN ORDER TO DEVELOP THE LINDEN HILL ACCESS LANE TO COUNTRY CLUB DRIVE IN COORDINATION WITH THE SOUTH KING STREET WIDENING PROJECT auction of 1 Country Club Drive and further no longer authorizes staff to acquire the property located at 1 Country Club Drive until such and further time as Council directs.
