REGULAR COUNCIL MEETING, MAY 15, 2017
CALL TO ORDER
The Regular Council Meeting of May 15, 2017, was convened at 6:00 P.M. by Mayor
Carrie Tergin.
ROLL CALL
The f ollowing Council Members were present for the roll call:
Present: Fitzwater, Graham, Hussey, Kemna, Mihalevich, Prather,
Schreiber, Ward, and Wiseman
Absent: Henry
A quorum was declared present.
ADOPTION OF THE AGENDA
A motion was made by Councilwoman Ward, seconded by Councilman Prather, to
adopt the agenda as published. The motion to adopt was approved unanimously.
MISCELLANEOUS AGENDA ITEMS
Mayor Tergin read and presented a proclamation to Dr. Kevin Rome, President of
Lincoln University, who has accepted the position as President of Fisk University in
Nashville, TN. Following the presentation of the proclamation to Dr. Rome, he thanked
the Mayor, Council, and the citizens of the community for making him and his family
feel welcome during the last four years they have lived in Jefferson City. The Mayor
and Council Members offered Dr. Rome best wishes on his new position.
City Administrator Steve Crowell made a presentation and introduced Mr. Michael
Shellman, Police Department Records Clerk, as Outstanding Employee Service Award
recipient for May, 2017. Mayor Tergin congratulated Mr. Shellman and thanked him
doing such outstanding work, and being so highly thought of and respected by co-
workers. She then presented him with a City coin and a token of appreciation from the
City.

(a) Amendment to Final PUD Plan for Property Located at 2725 Merchants Drive
A staff presentation was made by Plann ing & Protective Services Director Sonny
Sanders. At the conclusion of the staff presentation, Mayor Tergin opened the floor for
the public to make comments in favor of, or opposition to, the proposed PUD Plan.
No one came forward to testify on the issue.
Mayor Tergin declared the evidentiary portion of the public hearing concluded and
stated that the Council would now take up the associated pending bill.
2017-7 sponsored by Councilman Graham, entitled:
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A FINAL
PUD PLAN AMENDMENT FOR PROPERTY LOCATED AT 2725 MERCHANTS
DRIVE.
Bill 2017-7 was read third time by title, placed on final passage , and passed by the
following roll-call vote as Ordinance 15666:
Aye: Fitzwater, Graham, Hussey, Kemna, Mihalevich, Prather, Schreiber,
Ward, and Wiseman
Nay: None
(b) Rezoning 0.73 Acres Located at 748 West Stadium Blvd. from C-1 to C-2
A staff presentation was made by Planning & Protective Services Director Sonny
Sanders. At the conclusion of the staff presentation, Mayor Tergin opened the floor for
the public to make comments in favor of, or opposition to, the proposed rezoning.
No one came forward to testify on the issue.
Mayor Tergin declared the evidentiary portion of the public h earing concluded and
stated that the Council would now take up the associated pending bill.

Bill 2017-10 was read third time by title, placed on final passage , and passed by the
following roll-call vote as Ordinance 15667:
Aye: Fitzwater, Graham, Hussey, Kemna, Mihalevich, Prather, Schreiber,
Ward, and Wiseman
Nay: None
(c) Adoption of Capital Area Pedestrian & Bicycle Plan
A staff presentation was made by Transportation Planner Katrina Williams.
At the conclusion of the staff presentation, no one came forward to testify on the issue.
Mayor Tergin declared the evidentiary portion of the public hearing concluded and
stated that the Council would now take up the associated Resolution.
RS2017-2, sponsored by Councilman Graham, entitled:
A RESOLUTION OF THE CITY OF JEFFERSON, MISSOURI ENDORSING THE
ADOPTION OF THE CAPITAL AREA PEDESTRIAN & BICYCLE PLAN
A motion was made by Councilman Hussey for adoption of Resolution RS2017-2 as
presented, seconded by Councilwoman Ward, and approved unanimously by the
following roll-call vote:
Aye: Fitzwater, Graham, Hussey, Kemna, Mihalevich, Prather, Schreiber,
Ward, and Wiseman
Nay: None
APPOINTMENTS BY THE MAYOR
There were no appointments brought before the Council at this time.
PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS
Building Official Larry Burkhardt made a presentation regarding the different building
codes which had been under review by numerous committees and subcommittees over
the past several months. He presented the current editions of the building codes which
would be made available for review by the public in the City Clerk’s Office, and also
presented the timeline that adoption of these Codes would be brought to the Council by

ordinances in the coming months. Following his presentation, he answered questions
asked by the Council about the Fire code changes.
ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF
Mayor’s Announcements:
The Mayor attended the Law Enforcement Memorial Ceremony on May 6.
The Mayor attended Shelbyfest held May 4-6 in Jefferson City.
Mayor Tergin attended the retirement event honoring Police Officer Kevin
Kempker
The Mayor attended the Kids’ Safety Picnic
Mayor Tergin attended and awarded the “Mayor’s Choice Award” in the Corvette
Classic event held over the past weekend
The Mayor announced that the “Mayor’s Cup” annual golf tournament founded by
former Mayor John Landwehr would be held this year on July 21
The SSM “Dancing with the Stars” fund raiser event in which Mayor Tergin was a
participant, was held May 13 & 14, where about $100,000.00 was raised to
benefit cancer patients
Mayor Tergin announced that on July 1, the annual Concert Inside the Walls at
MSP would feature “Wynonna (Judd) and the Big Noise” band, and advised
everyone to order their tickets early.
Staff Announcements:
Public Works Director Matt Morasch announced that the May 18 Public Works &
Planning Committee meeting would be canceled and rescheduled due to some of
the Committee members being unable to attend.
LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE
Mayor Tergin announced that Jonathan Jackson had graduated May 13 and that a new
student would be selected as next year’s liaison in the next few months.

PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS
The following persons spoke regarding specific bills:
Mr. Christopher Graham, Bill 2017-9 (placing charter amendments on the August 8
ballot). He stated his opposition to the issue pertaining to changing the City Prosecutor
to an appointed position.
Mr. Charles Jackson, Bill 2017-9, also stated he was opposed to the City Prosecutor
position being an appointed rather than elected position.
Mr. Jack Deeken, Bill 2017-8, (placing storm water fee issue on August 8 ballot). He
stated he would prefer that the City wait until April to place this issue on the ballot to
allow for more discussion about the topic.
CONSENT AGENDA
The following items were brought before the Council for approval by Consent:
a. Minutes of City Council Meetings: May 1, 2017
b. Awarding Bid #2916 to Capital Materials, LLC, for Asphalt Paving Materials at an
estimated amount of $58,989.29
c. Awarding Bid #2913 to GT Distributors for Rifles and Sights in the amount of
$25,825.00
d. Awarding Sole Source Bid SS/82915 to Red th e Uniform Tailor for purchase of
Uniform Clothing for the amount of $40,000.00
e. Awarding Bid 2914 of Dulle Overhead Door, Inc., in the amount of $31.385.00 for
Overhead Door Replacement
A motion was made by Councilman Mihalevich to approve the Consent Agenda as
presented, seconded by Councilman Graham, and approved unanimously.

Councilman Graham requested that the rules be suspended and Bill 2017-14 placed on
final passage. There were no objections to the request for suspension of the rules.
Bill 2017-14 was then read second and third times by title, placed on final passage, and
passed by the following vote as Ordinance No. 15668:

A motion was made by Councilman Prather to approve the May 1, 2017, Closed
Session Minutes. The motion was seconded by Councilman Hussey, and approved
unanimously by the following roll-call vote:

Ward, and Wiseman

Mayor Tergin stated that, Pursuant to Sec. 610.021 of the Revised Statutes of Missouri,

A motion was made by Councilman Mihalevich to go into Closed Session at this time for
the above stated purposes, seconded by Councilman Fitzwater, and approved
