HomeMy Public PortalAbout2011_11_29_R143 - Petition for Writ of Special ElectionThe Town Of Leesburg, Virginia RESOLUTION NO. 2011-143 PRESENTED: November 29, 2011 ADOPTED: November 29, 2011 A RESOLUTION: TO DIRECT THE TOWN ATTORNEY TO PETITION THE LOUDOUN COUNTY CIRCUIT COURT FOR A WRIT OF SPECIAL ELECTION TO FILL THE COUNCIL VACANCY FOR A TERM ENDING DECEMBER 31, 2014. WHEREAS, Council Member Kenneth Reid was elected to the Loudoun County Board of Supervisors (BOS) during the general election November 8, 2011; and WHEREAS, Council Member Reid will be sworn in on December 9, 2011 and expected to start his term with the BOS on January 1, 2012; and WHEREAS, Council Member Reid's term on council will expire on December 31, 2014; leaving a vacancy on Town Council to be filled by appointment and special election; and WHEREAS, the Town Council believes that petitioning the Loudoun County Circuit Court for a Writ of Special Election upon the receipt of Council Member Reid's letter of resignation to the Town Clerk will effectuate a smooth transition; and WHEREAS, Town Council requests to hold the special election at the earliest and most convenient date possible, taking into consideration available dates as allowed by the Code of Virginia §24.2 -226 , §24.2- 282 §24.2 -507, §24.2 -612 and §24.2 -682 to allow for the special election process to commence in a timely manner; to maximize the length of time that the successful candidate will serve to complete the term; to avoid the confusion of holding a special election on the same day as the general election in November 2012; and THEREFORE, RESOLVED Town Council directs the Town Attorney to petition the Loudoun County Circuit Court for a Writ of Special Election as soon as practicable and legally permissible.
