A RESOLUTION: AUTHORIZING THE SALE OF REAL PROPERTY TO VIRGINIA
ELECTRIC AND POWER COMPANY ( "VEPCO ") PENDING
EXECUTION OF MEMORANDUM OF UNDERSTANDING BETWEEN
THE TOWN AND VEPCO
WHEREAS, Virginia Electric and Power Company ( "VEPCO ") desires to purchase Town-
owned property on the site of the Kenneth B. Rollins Water Treatment Plant in order to design and
construct an electric substation; and
WHEREAS, in addition to the purchase of the real property, VEPCO also desires to
purchase certain utility easements and access easements; and
WHEREAS, as the real property is located in the County of Loudoun, VEPCO is in the
process of seeking County approval for the substation and subdivision of the land; and
WHEREAS, while VEPCO is submitting its plans to the County, it is also negotiating with
the Town for the purchase of 2.8664 acres of land on the site of the Town's Water Treatment Plant
through a Memorandum of Understanding ( "MOU ") with the Town; and
WHEREAS, the terms of the MOU thus far are advantageous to the Town and the sale of
the real property will benefit the residents of the Town.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that the
Town Council authorizes the sale of approximately 2.8664 acres of Town -owned real property
located at the site of the Kenneth B. Rollins Water Treatment Plant, as well as conveying certain
utility easements and access rights to VEPCO for the construction of an electric substation, so long
as the Town and VEPCO enter into a MOU; and further, the Town Council authorizes the Town
Manager to execute the MOU on behalf of the Town.
