A RESOLUTION: TO INITIATE AN ORDINANCE TO DEFER THE EFFECTIVE DATE OF
ORDINANCE 2011 -0 -004, THE OFFICIAL ZONING MAP AND
ZONING ORDINANCE FOR THE CRESCENT FORM -BASED
DISTRICT, TO A DATE ON OR BEFORE JULY 31, 2013, TO
CONTINUE TO DEVELOP ORDINANCE AMENDMENTS FOR THE
CRESCENT FORM -BASED DISTRICT OR VARIATION THEREOF,
AND IMPLEMENT A NEW WORK SCHEDULE WITH STAKEHOLDER
INVOLVEMENT
WHEREAS, on February 23, 2011 the Leesburg Town Council adopted Ordinance 2011 -0-
004, amendments to the Zoning Ordinance to establish the Crescent Form -Based District with an
effective date of March 1, 2012 to allow staff time to address implementation issues; and
WHEREAS, on November 14, 2011, staff presented an update to Town Council on
implementation issues including concerns about implementation issues relating to the Regulating
Plan; and
WHEREAS, the Town Council directed staff to find ways to implement key provisions of
the Form -Based Code without reliance on a Regulating Plan; and
WHEREAS, on December 14, 2011 and January 4, 2012 staff presented ideas to the Form-
Based Code Steering Committee on how to implement form -based zoning without, or with limited
reliance on, a Regulating Plan, including the amendment of the B -2 District to incorporate key
provisions of the Crescent Form -Based District; and
WHEREAS, the Steering Committee reiterated support for zoning changes that will
encourage opportunities to achieve development and redevelopment that increase property values
while reinforcing and extending the character of the downtown; and
WHEREAS, the Steering Committee provided comments and recommendations regarding
the staff ideas to the Town Council as summarized in the staff memo to Town Council dated
January 9, 2012; and

CONTINUE TO DEVELOP ORDINANCE AMENDMENTS FOR THE
CRESCENT FORM -BASED DISTRICT OR VARIATION THEREOF,
AND IMPLEMENT A NEW WORK SCHEDULE WITH STAKEHOLDER
INVOLVEMENT
WHEREAS, on January 9, 2012 the Town Council held a work session to discuss the
various approaches to form -based zoning and indicated interest in pursuing further research into the
topic and to include public input and consensus building among stakeholders; and
WHEREAS, the public necessity, convenience, general welfare and good zoning practice
require consideration of the proposed amendments.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that:
SECTION I. Development of an Ordinance to defer the effective date from March 1, 2012
to a date on or before July 31, 2013 for the Crescent Form Based District (Ordinance 2011 -0 -004)
is hereby initiated.
SECTION II. Properties within the boundaries of the Crescent Form -Based District
(Ordinance 2011 -0 -004) shall not be vested until such time as the effective date, July 31, 2013, or a
prior date if so enacted by the Leesburg Town Council.
SECTION III. The Planning Commission shall hold a public hearing to consider this
deferral and report its recommendations to the Town Council pursuant to Chapter 22, Title 15.2-
2204 of the 1950 Code of Virginia, as amended.
SECTION IV. Amendments to the Official Zoning Map and the Zoning Ordinance for the
Crescent Form -Based District, or a variation thereof, shall be further considered and staff is hereby
directed to develop a new work schedule with stakeholder involvement for this review.
