A RESOLUTION: AWARDING THE CONSTRUCTION CONTRACT FOR THE LOWER
SYCOLIN CREEK SEWAGE CONVEYANCE SYSTEM TO BAY
COUNTRY ENTERPRISES, INC. IN THE AMOUNT OF $4,376,230
WHEREAS, the Lower Sycolin Creek Sewage Conveyance System project including the
Airport Branch Sewer, a pumping station at Phil Bolen Park, and the associated force main is a
funded capital improvement project; and
WHEREAS, in response to a public solicitation for construction bids due on December 14,
2011, the Town received bids from the following firms:
• Bay Country Enterprises, Inc. $4,376,230
• General Excavation, Inc. $5,259,787
• Norair Engineering Corp. $7,648,711
• Perry Engineering Company, Inc. $5,791,744
WHEREAS, the bids were evaluated by the Acting Director of the Department of Capital
Projects and the Chief Purchasing Officer in accordance with the Town's Purchasing Policy; and
WHEREAS, Bay Country Enterprises, Inc. was determined to be the lowest responsive and
responsible bidder; and
WHEREAS, this is a unit price contract and the estimated quantities multiplied by the unit
price have established the not to exceed contract price; and
WHEREAS, change order procedures are detailed in the bid specifications; and
WHEREAS, there is sufficient funding to award the construction contract; and

SYSTEM TO BAY COUNTRY ENTERPRISES, INC. IN THE
AMOUNT OF $4,376,230
WHEREAS, it is recommended to have a contingency in the amount of 15% -20% due to
the complexity of the project; and
WHEREAS, there are two projects that have available funding for use towards the
contingencies; those projects are the Water Storage Tanks in the amount of $100,000 and the
miscellaneous water and sewer projects PMW Farms in the amount of $150,000; and
WHEREAS, this would total approximately $610,000 for contingencies or approximately
14 %; and
WHEREAS, the Acting Director of Capital Projects and the Acting Director of Utilities
recommends approval of a construction contract to Bay Country Enterprises in the amount of
$4,376,230.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. Funding from the Water Storage Tanks in the amount of $100,000 is
transferred to the Lower Sycolin Sewage Conveyance Project.
SECTION II. Available funding from the Miscellaneous Water and Sewer Project PMW
Farms, in an amount not less than $150,000 and any additional funding available from this project
is transferred to the Lower Sycolin Sewage Conveyance Project.
SECTION III. The Town Manager is authorized to execute a contract, in a form approved
by the Town Attorney, with Bay Country Enterprises, Inc. in the amount of $4,376,230 for the
construction of the project.
