A RESOLUTION: APPROVING CHANGE ORDER NO.3 FOR DESIGN AND
ENGINEERING SERVICES ON THE BATTLEFIELD PARKWAY -
ROUTE 15 TO DULLES GREENWAY PROJECT IN THE AMOUNT
OF $239,624 AND AUTHORIZING THE TOWN MANAGER TO
EXECUTE CHANGE ORDER NO. 3
WHEREAS, the Battlefield Parkway — Route 15 to Dulles Greenway Project is a funded
capital project; and
WHEREAS, the existing design of the project is for a two -lane roadway to be widened to
four lanes at a later date; and
WHEREAS, in their FY 2012 -2017 Six Year Plan, the Virginia Department of
Transportation provided funding to the Town of Leesburg in the amount of $11 million for
completion of the entire 4 -lane roadway project; and
WHEREAS, the Town awarded a contract to Rinker Design Associates in February 2007
in the amount of $455,000 to provide design and engineering services for the design of Battlefield
Parkway between Route 15 (South King Street) and Route 621 (Evergreen Mill Road); and
WHEREAS, two change orders to the design contract have previously been authorized on
this project totaling $192,967, which results in a current contract amount of $647,967; and
WHEREAS, Change Order No. 3 in the amount of $239,624 is required in order to modify
the design to provide for construction of the complete four lane roadway between South King
Street and Evergreen Mill Road and to widen the existing two lane portion of the roadway to four
lanes between Evergreen Mill Road and the Dulles Greenway; and
A RESOLUTION: APPROVING CHANGE ORDER NO.3 FOR DESIGN AND
ENGINEERING SERVICES ON THE BATTLEFIELD PARKWAY -
ROUTE 15 TO DULLES GREENWAY PROJECT IN THE AMOUNT
OF $239,624 AND AUTHORIZING THE TOWN MANAGER TO
EXECUTE CHANGE ORDER NO. 3
WHEREAS, Change Order No. 3 increases the design contract amount by more than 25%
or $50,000, whichever is greater; and
WHEREAS, the Virginia Public Procurement Act and the Capital Improvements Policies
and Procedures Manual requires that change orders that cause the contract to be exceeded by the
greater of 25% or $50,000 by approved by Town Council; and
WHEREAS, the Battlefield Parkway — South King Street to Dulles Greenway Project has
sufficient funds in the budget to cover the associated costs; and
WHEREAS, the Acting Director of the Department of Capital Projects recommends that
this design change order be approved.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. Change Order No. 3 in the amount of $239,624 is hereby approved.
SECTION II. The Town Manager is authorized to execute Change Order No. 3 to the
design and engineering contract with Rinker Design Associates for the Battlefield Parkway —
South King Street to Dulles Greenway Project in the total amount of $239,624.
