HomeMy Public PortalAbout2012_02_14_R018 TLSE 2008-0012 Allman-StanfieldThe Town of Leesburg, Virginia PRESENTED: February 14, 2012 RESOLUTION NO. 2012 -018 ADOPTED: February 14. 2012 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE- 2008 -0012, GREENWAY BANK, A BANK WITH DRIVE -IN FACILITY, ON THE PROPERTY LOCATED NEAR THE INTERSECTION OF SOUTH KING STREET AND GREENWAY DRIVE. WHEREAS, One Covenant LLC has requested special exception approval to permit a 4,000 square foot building with a maximum of three (3) drive -thru lanes on the property having a Loudoun County Parcel Identification (PIN) number 273 -49 -2205, which is located near the intersection of South King Street and Greenway Drive; and WHEREAS, the property is zoned B -1, Community (Downtown) Business District and H -1, Old and Historic District; and WHEREAS, the Planning Commission held a duly advertised Public Hearing on December 1, 2011, a Work Session on December 15, 2011, and closed the Public Hearing January 19, 2012; and WHEREAS, the Planning Commission recommended conditional approval on January 19, 2012; and WHEREAS, Staff recommends conditional approval subject to the conditions dated February 14, 2012; and WHEREAS, the Town Council held a duly advertised Public Hearing on February 14, 2012; and WHEREAS, Town Council has determined the proposed use meets the special exception standards for a bank with drive -in facility set forth in the Zoning Ordinance; and -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE- 2008 -0012, GREENWAY BANK, A BANK WITH DRIVE -IN FACILITY, ON THE PROPERTY LOCATED NEAR THE INTERSECTION OF SOUTH KING STREET AND GREENWAY DRIVE. WHEREAS, Town Council has determined that the Approval Criteria of Zoning Ordinance Section 3.4.12 have been satisfied; and WHEREAS, Town Council has determined that the proposal would serve the public necessity, convenience, general welfare and good zoning practice. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that Special Exception application TLSE 2008 -0012, Greenway Bank, is hereby approved to permit a bank with drive -in facility on the property having a Loudoun County Parcel Identification (PIN) number 273 -49 -2205, which is located near the intersection of South King Street and Greenway Drive, subject to the following conditions: 1. Substantial Conformance: Development of this special exception use shall be in substantial conformance with the Special Exception Plat entitled "One Covenant — Stanfield Properties at Greenway Special Exception Plat " Sheet 16 of 17, last revised January 11, 20112 and prepared by Patton, Harris, Rust & Associates. 2. No Expressed or Implied Waivers: Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents. 3. Location: The drive -in window(s) shall be limited in the following capacity: a. Location of the drive -in window shall be on the building fagade facing the shared private access road, as illustrated on the special exception plat. b. The drive -in window shall not be located any closer than 20 feet to the building fagade facing Greenway Drive 4. Screening: Owner shall maintain a vegetative screen on the westerly side of the stacking lanes 5. Stacking Lanes: Owner shall be limited to a maximum of three (3) stacking lanes, as identified on the special exception plat. -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE- 2008 -0012, GREENWAY BANK, A BANK WITH DRIVE -IN FACILITY, ON THE PROPERTY LOCATED NEAR THE INTERSECTION OF SOUTH KING STREET AND GREENWAY DRIVE.
