HomeMy Public PortalAbout2012_02_14_R019 TLSE 2010-0012 Allman-StanfieldThe Town of Leesburg, Virginia PRESENTED: February 14, 2012 RESOLUTION NO. 2012 -019 ADOPTED: February 14, 2012 A RESOLUTION: APPROVING TLSE- 2010 -0012, STANFIELD CHILD CARE CENTER, A CHILD CARE FACILITY LOCATED ON THE PROPERTY HAVING PIN NUMBER OF 273 -39 -1389, AND LOCATED NEAR THE INTERSECTION OF SOUTH KING STREET AND GREENWAY DRIVE. WHEREAS, The Stanfield Company LLC has requested special exception approval to permit a child care center with a maximum of 208 children, on the property having a Loudoun County Parcel Identification (PIN) number 273 -39 -1389, which is located near the intersection of South King Street and Greenway Drive; and WHEREAS, the property is zoned B -1, Community (Downtown) Business District, and PRN, Planned Residential Neighborhood, and located within the H -1 and H -2, Old and Historic District and Historic Corridor Architectural Control Overlay District; and WHEREAS, the Planning Commission held a duly advertised Public Hearing on December 1, 2011, a Work Session on December 15, 2011, and closed the Public Hearing January 19, 2012; and WHEREAS, the Planning Commission recommended conditional approval on January 19, 2012; and WHEREAS, Staff recommends conditional approval subject to the conditions dated February 14, 2012; and WHEREAS, the Town Council held a duly advertised Public Hearing on February 14, 2012; and -2- A RESOLUTION: APPROVING TLSE - 2010 -0012, STANFIELD CHILD CARE CENTER, A CHILD CARE CENTER LOCATED ON THE PROPERTY HAVING PIN NUMBER OF 273 -39 -1389, AND LOCATED NEAR THE INTERSECTION OF SOUTH KING STREET AND GREENWAY DRIVE. WHEREAS, Town Council has determined the proposed use meets the special exception standards for a child care center set forth in the Zoning Ordinance; and WHEREAS, Town Council has determined that the Approval Criteria of Zoning Ordinance Section 3.4.12 have been satisfied; and WHEREAS, Town Council has determined that the proposal would serve the public necessity, convenience, general welfare and good zoning practice. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the Special Exception application TLSE 2010 -0004, Stanfield Child Care Center, is hereby approved to permit a child care center on the property having a Loudoun County Parcel Identification (PIN) number 273 -39 -1389, which is located near the intersection of South King Street and Greenway Drive, subject to the following conditions: 1. Substantial Conformance: Development of this special exception use shall be in substantial conformance with the Special Exception Plat entitled "One Covenant — Stanfield Properties at Greenway Special Exception Plat " Sheet 16 of 17, last revised January 11, 20112 and prepared by Patton, Harris, Rust & Associates. 2. No Expressed or Implied Waivers: Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents. 3. Capacity: The capacity of the child care center shall be limited to an enrollment of no more than 208 children. 4. Hours of operation: The child care facility shall be limited to the hours of 8:30 am to 4:00 pm. -3- A RESOLUTION: APPROVING TLSE- 2010 -0012, STANFIELD CHILD CARE CENTER, A CHILD CARE CENTER LOCATED ON THE PROPERTY HAVING PIN NUMBER OF 273 -39 -1389, AND LOCATED NEAR THE INTERSECTION OF SOUTH KING STREET AND GREENWAY DRIVE. 5. Summer program: The child care center may provide a summer program with a capacity of no more than 104 children. 6. Fencing: Due to the close proximity of parking, the fencing enclosing the required outdoor recreation shall include the following features: a. a masonry knee -wall surrounding the outdoor play areas constructed to a height of at least two (2.0) feet b. fencing material to include wrought iron or similarly looking material and /or style c. total height of the fencing including masonry base shall be a minimum of six (6) feet 7. Recreation Area, Square footage: The owner shall maintain at least 3,300 square feet of out -door recreation area. 8. Recreation Area, Capacity: Based on the limitation of 104 children per session, and the limitation in TLZO Section 9.3.4.A, the two (2) play areas shall be occupied by no more than: a. Play Area A, 2,400 sf. 24 children b. Play Area B, 900 sf. 9 children 9. Arrival/Departure Area: Four (4) arrival /departure spaces as shown on the special exception plat shall be striped and delineated as such on the property. 10. Parking: The Owner shall provide a minimum of 10 parking spaces for employees and four (4) arrival /departure spaces, for a total of 14 required spaces. Increases in employees beyond 10 shall require the demonstration of adequate on -site parking or amendment to any shared parking agreements.
