A RESOLUTION: INITIATING AMENDMENTS TO CHAPTER 7 OF THE LEESBURG
TOWN CODE REGARDING THE LEESBURG ARTS AND CULTURAL
DISTRICT
WHEREAS, the Town has developed a process and schedule for maintaining the Town
Code for the purpose of making minor changes resulting from annual state- mandated legislative
changes, the correction of errors, inconsistencies or problems discovered in the day -to -day
administration of the Town Code; and
WHEREAS, the Leesburg Arts and Cultural District Task Force ( "Task Force ") has
identified proposed amendments to Chapter 7 of the Leesburg Town Code related to the
administration of the Leesburg Arts and Cultural District; and
WHEREAS, staff and the Arts and Cultural District Task Force have identified that the
Ordinance should be amended to allow for graphic arts design businesses to be included in the
definition of a "Qualified Arts Organization "; and
WHEREAS, staff and the Task Force have identified that several long standing businesses
that may qualify as a "Qualified Arts Organization" have not yet applied for the benefits of
qualification due to the "five year business plan" requirement and therefore the time period for
application should be extended; and
WHEREAS, staff and the Task Force have identified the ordinance should be amended to
exempt businesses that have been in continous operation within the district for five (5) or more
years from the requirement of having to submit a "five year business plan".
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that:

SECTION I. Amendments to Chapter 7 of the Leesburg Town Code are hereby initiated
and referred to the Town Attorney and staff to make changes related to the Leesburg Arts and
Cultural District as identified above in addition to any further amendments to the Ordinance which
may be necessary to fully implement the benefits of an Arts and Cultural District.
SECTION 2. The Town Council shall hold a Public Hearing to consider these amendments
to the Ordinance.
