HomeMy Public PortalAbout2012_03_13_R033 TLSE 2011-0004 Catoctin Veterinary ClinicThe Town of Leesburg, Virginia PRESENTED: March 13.2012 RESOLUTION NO. 2012 -033 ADOPTED: March 13, 2012 A RESOLUTION: APPROVING TLSE- 2011 -0004, CATOCTIN VETERINARY CLINIC, A VETERINARY HOSPITAL LOCATED ON THE PROPERTY IDENTIFIED AS PIN NUMBER 231 -36 -4371 AND LOCATED AT 112 DRY MILL ROAD S.W. WHEREAS, Keith Robbins (owner of Catoctin Veterinary Clinic) has requested special exception approval to permit a veterinary hospital use in an existing office /medical building at 112 Dry Mill Road S.W., on the property identified as Loudoun County Parcel Identification (PIN) number 231 -36 -4371; and WHEREAS, the property is zoned B -1, Community (Downtown) Business District and is located within the H -1, Overlay, Old and Historic District; and WHEREAS, the Planning Commission held a duly advertised Public Hearing on February 16, 2012 and recommended conditional approval; and WHEREAS, Staff recommends conditional approval subject to the conditions dated March 13, 2012; and WHEREAS, the Town Council held a duly advertised Public Hearing on March 13, 2012; and WHEREAS, Town Council has determined the proposed use meets the special exception standards for a veterinary hospital set forth in the Zoning Ordinance; and WHEREAS, Town Council has determined that the Approval Criteria of Zoning Ordinance Section 3.4.12 have been satisfied; and -2- A RESOLUTION: APPROVING TLSE- 2011 -0004, CATOCTIN VETERINARY CLINIC, A VETERINARY HOSPITAL LOCATED ON THE PROPERTY IDENTIFIED AS PIN NUMBER 231 -36 -4371 AND LOCATED AT 112 DRY MILL ROAD SW. WHEREAS, Town Council has determined that the proposal would serve the public necessity, convenience, general welfare and good zoning practice. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that Special Exception application TLSE - 2011 -0004, Catoctin Veterinary Clinic, is hereby approved to permit a veterinary hospital use in an existing office /medical building at 112 Dry Mill Road S.W., on the property identified as Loudoun County Parcel Identification (PIN) number 231 -36- 4371, subject to the following conditions: 1. Substantial Conformance: Development of this special exception use shall be in substantial conformance with the "Catoctin Veterinary Clinic" Special Exception Plat prepared by Paciulli, Simmons & Associates dated September 30, 2011 and last revised January 26, 2012. 2. No Expressed or Implied Waivers: Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or the Land Development Official or as shown on the approved Special Exception Plat and supporting documents. 3. Use Standards: The facility shall be adequately soundproofed and control odor. 4. Screening of Ground Level HVAC units: The applicant shall screen ground level HVAC equipment from view of Town Branch Terrace and Dry Mill Road. 5. Dry Mill Road Sidewalk Repair/Replacement: As part of site development and prior to occupancy permit for the veterinary use, the applicant shall repair the existing concrete sidewalk to correct drainage problems or alternatively, shall construct a new sidewalk meeting current Town standards. 6. License: The applicant shall maintain all necessary Commonwealth of Virginia licenses and permits for a veterinary hospital use. 7. Hours of operation: The veterinary hospital use shall be limited to between the hours of 8:00 am and 8:00 p.m., Monday through Saturday. -3- A RESOLUTION: APPROVING TLSE- 2011 -0004, CATOCTIN VETERINARY CLINIC, A VETERINARY HOSPITAL LOCATED ON THE PROPERTY IDENTIFIED AS PIN NUMBER 231 -36 -4371 AND LOCATED AT 112 DRY MILL ROAD SW.
