A RESOLUTION: AUTHORIZING AN AGREEMENT, APPROVING A PERFORMANCE
GUARANTEE, APPROVING A WATER EXTENSION PERMIT,
AND ACCEPTING A CASH PAYMENT IN LIEU OF CONSTRUCTION
OF A SMALL SECTION OF SIDEWALK FOR LEESBURG TOYOTA
(TLPF- 2011 -0009)
WHEREAS, Leesburg Motors, LLC, the developer of Leesburg Toyota has requested approval
of a corporate surety bond from Liberty Mutual Insurance Company in the amount of $1,060,000 to
guarantee the public improvements; and
WHEREAS, the Director of Public Works recommends approval of a contract for installation
of public improvements and acceptance of a performance guarantee for Leesburg Toyota; and.
WHEREAS, the Director of Public Works also recommends acceptance of a cash payment in
the amount of $9,100 in lieu of construction of a small section of sidewalk for Leesburg Toyota.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The Town Manager shall execute the contract for public improvements for the
improvements shown on the plans to be approved by the Director of Plan Review for Leesburg Toyota.
SECTION II. A corporate surety bond from Liberty Mutual Insurance Company in the amount
of $1,060,000 is approved as security to guarantee installation of the public improvements shown on
plans to be approved by the Director of Plan Review for Leesburg Toyota.
SECTION III. The extension of municipal water for Leesburg Toyota is approved in
accordance with Section 34 -25 of the Town Code.
SECTION IV. The Town Council hereby accepts a cash payment of $9,100 in lieu of
construction of a small section of sidewalk for Leesburg Toyota.

SECTION V. The $9,100 shall be held by the Town to be used for the construction of a small
section of sidewalk by the Town or other parties as authorized by the Town.
