A RESOLUTION: TO DIRECT THE TOWN ATTORNEY TO SUBMIT FOR
PRECLEARANCE TO THE U.S. DEPARTMENT OF JUSTICE (DOJ)
THE TOWN CHARTER AMENDMENT TO MOVE THE DATE OF
THE TOWN COUNCIL AND MAYORAL ELECTIONS FROM MAY
TO THE GENERAL ELECTION DATE OF NOVEMBER BEGINNING
IN NOVEMBER OF 2012, AND A PROVISION THAT TOWN
ELECTIONS WILL REMAIN NONPARTISAN.
WHEREAS, the Town Council adopted Ordinance No. 2011 -0 -22 on December 13,
2011 to amend the election date of the Mayor and Members of Council and adding, elections are
to be non - partisan; and
WHEREAS, the Town Council requested November 29, 2011 the proposed Charter
Amendment be voted on by the Virginia General Assembly; and
WHEREAS, the Charter was enacted by the Virginia General Assembly on March 21,
2012, Act H 906; and
WHEREAS, to effectuate the Charter Amendment it must be submitted to the DOJ for
preclearance in accordance with Section 5 of the Voting Rights Act and Code of Virginia 15.2-
203; and
WHEREAS, THEREFORE, RESOLVED Town Council directs the Town Attorney to
submit for preclearance to the DOJ the Town Charter Amendment as soon as applicable and
permissible.
