VIRGINIA LINE OF DUTY PROGRAM
PRESENTED: April 24, 2012
ADOPTED: April 24, 2012
WHEREAS, the Commonwealth of Virginia created a Line of Duty Fund to pay benefits to
certain public safety personnel who become disabled or die in the line of duty; and
WHEREAS, the Virginia General Assembly, in its 2010 session, shifted the cost of paying past
and present Fund liabilities from the state to local governments and designated the Virginia Retirement
System (VRS) as the investment manager for the fund; and
WHEREAS, annual per capita contributions to VRS will increase from $233.89 in FY 2012 to
$474.14 in FY 2013, and $521.97 in FY 2014 for the Town's 85 covered police officers; and
WHEREAS, local governments in the State Line of Duty Fund must make an irrevocable
decision by no later than July 1, 2012 on whether to remain in the State Line of Duty Fund or self fund its
line of duty claims; and
WHEREAS, as part of its contract solicitation for worker compensation, and general liability and
property insurance coverage for FY 2013, the Town has asked the Virginia Municipal League (VML) and
Virginia Association of Counties (VACO) to offer proposals for line of duty coverage.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that upon
receipt of proposals for line of duty coverage from VML and VACO, the Town Manager will present a
recommendation to the Town Council on whether to continue with the State Line of Duty Fund or self
fund line of duty claims at the May 21, 2012 Work Session of the Town Council.
