WHEREAS, the Applicant, Destiny Creative Arts Center, a ministry of Destiny Church, has requested special exception approval to permit a child care center within existing tenant spaces in the Bellwood Commons Shopping center, located at 545 -D East Market Street, on the property identified as Loudoun County Parcel Identification (PIN) number 188 -15 -9031; and WHEREAS, the property is zoned B -2, Established Corridor Commercial District, and is located within the H -2, Historic Corridor Architectural Corridor Overlay District; and WHEREAS, the Planning Commission held a duly advertised Public Hearing on May 3, 2012 and recommended conditional approval; and WHEREAS, Staff recommends conditional approval subject to the conditions dated June 12, 2012; and and WHEREAS, the Town Council held a duly advertised Public Hearing on June 12, 2012; WHEREAS, Town Council has determined the proposed use meets the special exception standards for a child care center set forth in the Zoning Ordinance; and WHEREAS, Town Council has determined that the Approval Criteria of Zoning Ordinance Section 3.4.12 have been satisfied; and -2- A RESOLUTION: APPROVING TLSE- 2012 -0002, DESTINY CREATIVE ARTS CENTER, A CHILD CARE CENTER LOCATED ON THE PROPERTY IDENTIFIED AS PIN NUMBER 188 -15 -9031 AND LOCATED AT 545- III W.�.yl85/_11 .1114 cl"17111I WHEREAS, Town Council has determined that the proposal would serve the public necessity, convenience, general welfare and good zoning practice. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that Special Exception application TLSE- 2012 -0002, Destiny Creative Arts Center, is hereby approved to permit a child care center within the existing tenant spaces at Bellwood Commons Shopping Center at 545 -D East Market Street, on the property identified as Loudoun County Parcel Identification (PIN) number 188 -15 -9031, subject to the following conditions: 1. Substantial Conformance: Development of this special exception use shall be in substantial conformance with the Special Exception Plat consisting of the revised landscape plan sheet from the site plan prepared by Patton Harris Rust dated 9- 29 -89, as submitted with the application on February 6, 2012. 2. No Expressed or Implied Waivers: Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents. 3. Limited Duration: The use of the child care center shall be limited to a period of no more than five (5) years from the date of Town Council approval. 4. Location and Area: The location of the child care center shall be limited to the two (2) existing tenant spaces outlined in green on the special exception plat and in Conditions Figure 1. 5. Hours of operation: The use of the child care center shall be limited to the hours of 8:30 -am to 4 pm, Monday through Friday. No more than two programs, each of which shall last no longer than three and a half (3.5) hours, may be offered at this facility. 6. Parking and Signage: Applicant shall provide no less than four (4) parking spaces with signage in the area outlined in blue on the special exception plat and in Conditions Figure 1. These parking spaces shall be reserved between the hours of 8:45 am to 9:15 am, 11:15 am to 12:45 pm, and 3:00 pm to 3:30 pm. Conditions Figure 1 7. Loading Area Procedures: Applicant shall prepare an arrival and departure procedure, which shall be given to the parents of children attending the facility. The procedure shall identify the area and process of loading and unloading at the rear facility access and identify the four (4) off - street parking spaces reserved for parking. Applicant shall provide Staff a copy of the arrival and departure procedures no later than 30 days after the approval of the special exception. 8. Loading Area: The area located behind the tenant spaces, outlined in orange on the special exception plat and in Conditions Figure 1, used by the Applicant for the arrival and departure zone shall be striped. The loading area shall accommodate loading and unloading for two vehicles in compliance with TLZO Section 9.3.4.E. PASSED this 12th day of June, 2012 Kristen C.
