Mayor Tyrell called the regular meeting of the City Council to order at 7:30 P. M. Elder Harold Calkins, of the Seventh Day 2. Adventist Church, 9664 Broadway, Temple City, gave the invocation; 3. following which Mayor Tyrell led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Clemson, Harker, Merritt, Tyrell ABSENT: Councilman - Beckley ALSO PRESENT: City Attorney Martin, Planning Director Dragicevich, Public Works Director.Pizzorno, Traffic Engineer Envall, Engineer Krelle, and City Manager Koski Note was made that Councilman Beckley's absence was due to his attendance at a Scouts Award meeting as a Council representative and his absence was excused. APPROVAL OF MINUTES: Regular meeting of Sept. 6, 1966. The Chief Deputy City Clerk corrected the minutes of the regular meeting of September 6, 1966, on page 2 the last paragraph, the requested authorization to open a checking account at the First Western Bank, should also have included authorization for the City Treasurer and City Clerk to sign the checks. Councilman Clemson moved to approve the minutes as corrected, Councilman Merritt seconded, and the motion carried unanimously. UNFINISHED BUSINESS: 6. CANVASS OF SPECIAL ANNEXATION NO. 11 AND NO. 12 ELECTIONS City Manager Koski presented the Canvass of Annexation No. 11 Election as follows: Precinct No. 1, total number of ballots voted: 379 Precinct No. 2, total number of ballots voted: 205 Precinct No. 3, total number of ballots voted: 175 Number of Absentee ballots voted: 11 Total ballots voted: 770 "Yes" Votes: 236 "No" Votes: 534 Total Votes: 770 The City Manager presented the Canvass of Annexation No. 12 Election as follows: Precinct No. 4, total number of ballots voted: 323 Precinct No. 5, total number of ballots voted: 217 Precinct No. 6, total number of ballots voted: 2S5 Number of Absentee ballots voted: 17 Total ballots voted: 817 "Yes" Votes: "No" Votes: 183 634 Total Votes: 817 Councilman Merritt moved in view of election results that both Annexation No. 11 and No. 12 be terminated and the results of the Elections be spread upon the records, Councilman Harker seconded, and the motion was carried by the following roll call vote: AYES: Councilmen- Clemson, Harker, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilman- Beckley PUBLIC HEARING: CONTINUED: petition re Temple City Animal Hospital City Attorney Martin advised a petition with about forty names hac been submitted in January protesting the noise at the Temple City Animal Hospital. The Petition was presented to the Council, and they recommended investigation by the staff and a conference with Dr. Darr Jobe, owner of the hospital, in an attempt to alleviate the problem. Surveys were to be made of sound level and possible 953 Council Minutes, Sept. 20, 1966, page 2 structural changes recommended. The matter was to be reconsider- ed by the Council on June 8. Prior to that date several other complaints were received regarding other kennels and the Council deferred action until all could be solved. In July a Public Hearing was held before the City Council following consideration and recommendations from the Planning Commission, regarding kennels generally, and in August an urgency ordinance was adopter:` which required a conditional use permit for a kennel operation. Following this the continued Public Hearing from July 19 was set for Sept. 20, 1966. Mayor Tyrell declared the continued public hearing reopened, and asked Dr. Jobe if he wished to be heard. Dr. Darr Jobe, owner of the Temple City Animal Hospital, 5406 Rosemead Blvd., stated to date he had spent $13,680. on engineer report, lawyers fees, insulation and other improvements some of which are not as yet completed. He advised the Planning Director and City Manager had looked at the installation which he estimat- ed to be about 1/2 completed and he estimated it would be the end of March, 1967, before he could complete planned improvements as at the present time he has done as much as he can affort right now, they are installing cages at the present time and he hopes to get everything done as soon as possible. The City Attorney advised the petitioners should be heard from. Ray Burger, 5417 N. Sultana Ave., stated there is work being done over there but felt there was not much improvement as yet. He felt this could be continued on and on and he felt a definite time should be set for elimination of the problem. Mr. Stahlheber, 9033 Rancho Real, felt Dr. Jobe was trying to do something about the noise but also felt some definite time should be set when the work will be completed and decisions made. Mrs. Sheperd, 9028 Rancho Real, felt consideration should also be given to noise outside the building when the dogs are outside. It is all open and very noisy when the dogs are out. Dr. Jobe advised the dogs are never out at night, and any noise heard at night is from inside the hospital, and this is one of the things he is trying to control. He stated they cannot keep all dogs quiet at all times and that is why he is located in M -1 zone. Georgia Maxey, 9823 Hallwood, stated Dr. Jobe is a substantial businessman, has been here some time and is doing everything he can and he is located in the right zone and is within his rights. Mrs. Manlove, 9035 E. Olive, stated he was not there before the residences, and that unless the open spaces are not enclosed nothing is going to do any good to stop the noise. ft one else came forward to speak. Councilman Merritt moved to close the public hearing, Councilman Harker seconded, and the motion carried unanimously. Mayor Tyrell felt the problem is one the Council should consider and that the petitioners had been very patient, and also Dr. Jobe had certainly shown good faith not only in investment of funds to date but there will be considerably more expense to him. He suggested that Dr. Jobe be requested to make every attempt to complete the balance of improvements recommended to him not later than March 31, 1967. If at that time the nuisance has not been eliminated to the satisfaction of the protestants a survey should be taken to determine amount of noise eliminated. Councilman Clemson agreed with Councilman Harker but felt Dr. Jobe should be given a chance to complete improvements and felt a deadline of May 23, 1967 would be adequate. Councilman Merritt also agreed with Councilman Harker and comment- ed on the amount of expense Dr. Jobe has gone to and the progress he has made. He felt if extended to March 31, Dr. Jobe could ask for an extension and this could go on and on. He stated he did not think the noise could get down to whePC you would not hear anything at all, but should be brought down to where a person could live with it. Mayor Tyrell stated with hot weather normally starting in June at which time the noise is the worst, and Dr. Jobe's expenditure to date has been about $2000. per month, he felt March is too early a date to set for completion. Following discussion Councilman Harker moved to reopen the con- tinued hearing on May 23, 1967, at 7:30 P. M., Councilman Merritt seconded and the motion carried unanimously. Dr. Jobe asked what assurance he would have if he expended say $25,000. that it would be satisfactory and was advised that the 954 Council Minutes, September 20, 1966, page 3 Council could not guarantee anything by Mayor Tyrell. PUBLIC HEARING: 7:30 P. M. Sidewalks, Baldwin Ave., east side, between Lower Azusa and La Rosa Public Works Director Pizzorno reported petitions have been sign- ed by owners of frontage of 1100 ft. of the total of 1500 ft, or 73 %, requesting sidewalks on the east side of Baldwin Ave., be- tween Lower Azusa and La Rosa. Mayor Tyrell declared the public hearing opened, and asked if anyone wished to speak for or against this petition. No one came forward to speak. Councilman Merritt moved to close the public hearing, Councilman Clemson seconded, and the motion carried unanimously. Councilman Harker moved to find the project in public interest and instruct the Supt. of Streets to cause the work to be done, Councilman Clemson seconded, and the motion carried unanimously. 7. PROPOSED ORDINANCE RE CLARIFICATION OF R -2 ZONE: NO. 66 -209 City Attorney Martin presented Ordinance No. 66 -209 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 503 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO LOT AREAS IN R -2 ZONE. He ex- plained this allowed only two houses in R -2 zoning no matter how large the lot. The City Manager explained a variance could be filed for any variation to the ordinance. Councilman Merritt moved to waive further reading of Ordinance No. 66 -209, Council- man Clemson seconded, and the motion carried unanimously. As this was the first reading no further action was taken. NEW BUSINESS: 8. TEMPLE CITY SHOPPING CENTER: Request for permission to hang flag- The City Manager presented a request from the committee of the Temple City Shopping Center to replace their flags which were up last spring and taken down during the summer. They wish to replace them for September, October and November. Following discussion Councilman Clemson moved to approve subject to re- moval for placement of the American Flag on Columbus Day, Oct. 12 and Veterans Day, Nov. 11, Councilman Harker seconded, and the motion carried unanimously. Councilman Merritt also asked that they be requested to renew or replace some of the banners which were in pretty bad condition,. 9. RESOLUTION NO. 66 -658: Warrants & Demands City Manager Koski presented Resolution No. 66 -658 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $22,074.46, DEMAND NOS. 8743 THROUGH 8795. Councilman Merritt moved to adopt Resolution No. 66 -658, Councilman Clemson seconded, and the motion carried unanimously. 10. TRAFFIC COMMISSION RECOMMENDATIONS: Item 5. ENCINITA AVE. BETWEEN LONGDEN AVE. & WOOLLEY ST. The Traffic Engineer presented a recommendation for a No Stopping At Any Time" sign to be placed on Encinita from Longden to Woolley St. and center line striping on paved dedicated portion of the same area. Also edge of road striping on the east side of this pavement. He reported a survey of residents on the west side were in favor of the recommendation. Councilman Clemson moved to approve, Councilman Harker seconded, and the motion carried unanimously. Item 6. KAUFFMAN AVE. & LAS TUNAS DR. Traffic Engineer Envall presented the recommendation for install,.. tion of a pre -empt signal at Las Tunas Drive and Kauffman, with pre-empt control button to be activitated from Fire Engine Co. 47, to turn all four signals to solid red for the length of time it takes for emergency equipment to move out onto Les Tunas Dr. The purpose is in support of Fire equipment from Engine Co. 47. Following discussion Councilman Clemson moved to approve this recommendation, Councilman Merritt seconded, and the motion was unanimously carried. Item 8. RANDWICK DRIVE & DEGAS ST. The Traffic Engineer present- ed the recommendation that a "Not a Through Street" sign be plac- ed on the north side of Randwick at the west line of Degas Ave. Councilman Merritt moved to approve, Councilman Harker seconded, and the motion was unanimously carried. 955 Council Minutes, September 20, 1966, page 4 Item 10. ROSEMEAD BLVD. & PENTLAND ST. Traffic Engineer advised the Traffic Commission recommends placement of a boulevard stop sign and stop and stop -bar pavement markings on the south approach of the east Rosemead service road to Pentland. Coun- cilman Merritt moved to approve, Councilman Clemson seconded, and the motion was unanimously carried. 11. COMMUNICATIONS: a. City Manager Koski presented a request for a charitable soli- citation permit from the Muscular Dystrophy Assns. of America, Inc. Los Angeles County, from Dec. 1 -31. Councilman Harker mov- ed to approve, Councilman Merritt seconded, and the motion was carried unanimously. b. The City Manager presented a request from Mrs. Wilbur Gasti- neau, Pres. of Temple City Council of Parents and Teachers to proclaim October as PTA Membership Month in Temple City, and to urge all concerned to become active members. Councilman Merritt moved to approve, Councilman Clemson seconded and the motion was unanimously carried. c. City Manager Koski presented a request for Council reconsid- eration re granting a permit for solicitation for UNICEF, from Jon Lacey the Asst. Minister for the Temple City Christian Church and similar letters from Mrs. Ruth A. Weiss, Rev. Anthony Leuer, Mrs. John Waller, Rev. Dennis Savage, Mrs. Stanley Herdrich, Mrs. John C. Holthaus, Mrs. Richard Morrison, Mrs. L.R.Taylor. He read the original request submitted by Mrs. Fern B. Hull for a permit for UNICEF solicitation for money on Hallowe'en. The following were present and spoke in favor of the solicitation: Mrs. Fern B. Hull of 9116 Ardendale Ave., Eleanor Bartlett of 9638 Callita Ave., Mrs. Ed. Sawyer, Mrs. John C. Holthaus, Mrs. Lee Taylor of 6133 N. Muscatel. Councilman Merritt stated the Council had approved some agencies that were not necessarily in Temple City. However UNICEF is strictly for out of the country. This was the concern of Coun- cilman Harker and Clemson also. Mayor Tyrell stated one of the issues of incorporation and still is an issue, was the volumes of throw away papers and door to door solicitation which the Council has tried to control as much as possible. It was also brought out there were many children in Los Angeles County hungry at night. Mr. Bill Burt, 4923 N. Ryland, spoke against UNICEF and stated over 5000 Los Angeles County children go to bed hungry every night. Mayor Tyrell stated under section 4504 of the Temple City Munici pal Code it states a permit shall be issued if the Council finds the application to be truthful, and in good faith and in all probability no fraud would be perpetrated on the public. In view of these facts Councilman Harker moved to grant the request. Councilman Clemson seconded, and the motion was carried unani- mously. d. The City Manager presented a request from the City of Santa Fe Springs requesting a proclamation supporting their drive to collect canned food, clothing, etc, for earthquake victims in Turkey where their Sister City is located. Councilman Merritt moved to so proclaim, Councilman Clemson seconded and the motion carried unanimously. e. Request for a permit for teenagers to solicit funds Dec. 10 and 11 for St. Jude Childrens Research Hospital for aiding Leukemia Stricken American Children "ALSAC ". Councilman Merritt moved to approve, Councilman Clemson seconded, and the motion carried unanimously. 12. TIME FOR THOSE I N THE AUDIENCE WHO WISH TO SPEAK: Ray Burger, 5417 Sultana Ave., thanked the Council for their consideration of the dog situation on Rosemead, and also for the curb and gutter going in on the south side of Olive. 13. MATTERS FROM CITY OFFICIALS: City Manager Koski presented a request from the Temple City High School Pep Commission for a small parade on Sept. 22 in connec- tion with the first football game. Lt. Baker advised there was no problem and that this was an annual event. Councilman Clemsc moved to approve, Councilman Merritt seconded, and the motion carried unanimously. The City Manager presented a request from the Foley Advertising Co. for permission to hang County Fair banners on Las Tunas Dr. 956 Council Minutes, September 20, 1966, page 5 and Temple City Blvd. Councilman Merritt moved to approve sub- ject to insurance coverage and to follow the picnic banners, Councilman Clemson seconded, and the motion carried unanimously, Wm. Krelle of Krelle & Lewis, Engineers, presented the two bids received for the construction of Parking Districts #1, #3, and #4. He explained in detail the one complete bid received from MacWell on all four parts of the construction which was 43% over the estimate. Also Osborne Co. of Pasadena only bid Sche- dule #1 for curb and gutter, paving, surfacing, etc. which was 30% over the estimate on #1. Following discussion Engineer Krelle stated they did not feel these bids were realistic and he recommended they both be rejected and the project delayed until January which would allow the project to go to bid in Dec. with work to start after the holidays. This would give ample time for bids to be received and would also allow ample time for completion. Public Works Director Pizzorno concurred with the recommendations of the Engineer. Councilman Harker moved to reject all bids, Councilman Merritt seconded, and the motion was unanimously carried. Public Works Director Pizzorno reported on the surplus property advertised for bid on Baldwin Ave. He had received a bid from John Hewko, 10109 La Rosa Dr., to buy the house and garage at 5452 Baldwin Ave. for $1500. on condition he be granted a zone variance to move it to Lot 5 at 21396 Rosedale Dr. where set- backs would not meet requirements. He also presented a check for $150.-as 10% of the offer submitted. The Planning Director advised the Council he had checked this house and he felt the house is large for the lot the applicant is proposing to move it on, and that it would require a variance from the Planning Commission. Following discussion the City Attorney suggested the bid be held and an application be made to the Planning Commission for a determination prior to Council consideration. Councilman Clemson so moved, Councilman Merritt seconded, and the motion carried unanimously. Public Works Director Pizzorno advised a representative from the County was to have been present to report on the airport at El Monte, and was unable to attend and requested this be held over until the next Council meeting, to which the Council agreed. City Manager Koski reported on the political signs that he had written letters to the candidates who will have them off the end of this week. Inasmuch as Councilman Beckley did not arrive for the Council Meeting Councilman Harker moved he be excused as he was parti- cipating in a Boy Scout awards ceremony as a Council representa- tive, to which the Council agreed unanimously. 14. ADJOURNMENT: Mayor Tyrell declared the Council adjourned until the next regular meeting of the City Council on October 4, 1966, at 7:30 P. M. in the Council Chambers, 5938 Kauffman Ave., Temple City.
