HomeMy Public PortalAbout012-2002 - Rezoning - 1900 E Main, 15-19 N 19 & 16 N 19th Street ORDINANCE NO- 12 - 2002 A SPECIAL ORDINANCE AMENDING THE REZONING AT 1900 EAST MAIN STREET, 15-19 NORTH 19TH STREET AND 16 NORTH 19TH STREET WHEREAS, the Zoning Map designates and describes the property at 1900 East Main Street as R-3 Special Use District, 15-19 North 19th Street as R-3 District; and WHEREAS, it is desirable to change the zoning designation to a R-3 Special Use District to allow the use of the properties for construction of an addition to the optometrist office and for accessory parking to the optometrist office, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation of the properties commonly knows as 1900 East Main Street, 15-19- North 19th Street, and 16 North 19th Street and more particularly described below are herby changed to a R-3 Special Use District to allow the use of the properties for construction of an addition to the optometrist office and for accessory parking to the optometrist office as illustrated in the attached site plan. The subject real estate is more particularly described as follows: Being a part of Lot Number Seven (7) in L. & H. H. Fetta Addition to the City of Richmond, Indiana, and being more particularly described as follows: Beginning at a point seventy-three (73) feet North of the intersection of the north line of East Main Street and the east line of North Nineteenth (19th) Street in said City of Richmond, Indiana, and running thence, from said beginning point, East at right angles to the east line of said North Nineteenth (19th) Street, a distance of ninety-four (94) feet; thence North parallel to the east line of said North Nineteenth (19th) Street, a distance of fifty-six and twenty-five Hundredths (56.25) feet; thence West, a distance of ninety-four (94) feet to a point in the east line of said North Nineteenth (19th) Street, said point being fifty-six and twenty-five hundredths (56.25) feet North of the place beginning; thence south, along the east line of said North Nineteenth (19th) Street, a distance of fifty-six and twenty-five hundredths (56.25) feet to the place of beginning. ALSO: Lot Seven (7) in that part of the City of Richmond laid out by Louisa Fetta, Henry H. Fetta and Henry Kehlenbrink in the Southeast Quarter (SE1/4) of Section Thirty-three (33), Township Fourteen (14), Range One (1) West, said premises being located at the Northeast corner of Main and Nineteenth (19th) Streets, subject to the condition of record that the Twelve foot (12’) strip on the East side of Nineteenth (19th) Street, abutting on said Lot Seven (7) should become a part of said Nineteenth (19th) Street upon removal of the building standing upon the same. EXPRESSLY SUBJECT TO: Indenture dated September 27, 1926 from Standard Oil Company herein to Pohlmeyer Property Corporation recorded October 5, 1926 in Deed Record 167, page 479 conveying a portion of the above described real estate described as follows: That part of lot Seven (7) in that part of the City of Richmond, Indiana, laid out by Louisa Fetta, Henry H. Fetta and Henry Kehlenbrink, more particularly described as: Beginning at a point in the east line of north 19th Street, seventy-three (73) feet north of the southwest corner of said lot seven (7); running thence north along the east line of North 19th Street, as said Street is now laid out, one hundred forty-three feet, six inches (143’6”); thence east at right angles to the east line of North 19th Street, one hundred thirty-seven (137) feet to the west line of an alley; thence south along the west line of said alley, seventeen (17) feet; thence southwesterly on an inverse curve and on the westerly boundary of said alley, thirty-three (33) feet to a point one hundred twenty-two (122) east of the east line of North 19th Street; thence west at right angles to the east line of North 19th Street; twenty-eight (28) feet; thence south parallel to the east line of North 19th Street, ninety-six (96) feet; thence west at right angles to the last mentioned line, ninety-four (94) feet to the point of beginning. ALSO: A part of Southeast Quarter of Section Thirty-three (33) in Township Fourteen (14) of Range One (1) West, and bounded as follows: Beginning at a point on the West line of Nineteenth Street, in the City of Richmond and said County and One Hundred Fifty-six (156) feet north of the North line of Main Street in said City, and at the North side 4 of an alley Sixteen (16) feet wide running East and West; thence west along said alley (North side) One Hundred three (103) feet to the ground belonging to Henry Cutter; thence North along same Thirty-two (32) feet; thence East and parallel with said alley One Hundred Three (103) feet to Nineteenth Street; thence South along the West line of said street Thirty-two (32) feet to the place of beginning; and being a part of Lot Number Four in L & HH Fetta Addition to the City of Richmond, Indiana.
