A RESOLUTION: STATEMENT AGAINST EMINENT DOMAIN CONSTITUTIONAL
AMENDMENT
WHEREAS a Virginia constitutional amendment will be voted on November 6`" by voters in
Virginia, and
WHEREAS the amendment will likely increase costs of public projects for localities, including
Leesburg, where private property of businesses may be needed, by requiring payment for "lost profits" and
"lost access ", and
WHEREAS from the amendment projects such as public - private partnerships that are primarily for
"increasing jobs, increasing tax revenue, or economic development" may be disallowed, and
WHEREAS the amendment places the complete burden of proof as to whether a project is primarily
for economic development on the localities, including Leesburg, and
WHEREAS the amendment does not materially improve protection of property of homeowners, and
WHEREAS the uncertainties related to the amendment will likely result in many more lawsuits, and
WHEREAS the likely increased costs and reduction in projects for increasing job, increasing tax
revenue, or economic development may require the Town of Leesburg to increase property taxes to maintain
the same or similar services, then
RESOLVED that the Town of Leesburg opposes the 2012 constitutional amendment, and encourages
its rejection on November 6.
