HomeMy Public PortalAbout2012_12_11_R132 To Direct Final Revisions to the Crescent Design DistrictThe Town of Leesburg, Virginia PRESENTED: December 11, 2012 RESOLUTION NO. 2012 -132 ADOPTED: December 11, 2012 A RESOLUTION: TO DIRECT FINAL REVISIONS TO THE CRESCENT DESIGN DISTRICT WHEREAS, the Crescent Design District presents opportunities to achieve development and redevelopment that increase property values while reinforcing and extending the character of the downtown in appropriate areas; and WHEREAS, on November 13, 2012 the Town Council held a public hearing on the proposed Crescent Design District; and WHEREAS, as a result of two subsequent work sessions on November 26, 2012 and December 10, 2012 the Town Council has identified areas where the Crescent Design District may be improved to achieve the goals of the Crescent District Master Plan and the Town Plan; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require consideration of the proposed revisions. that: THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia hereby SECTION I. Town Staff shall draft revisions to the Crescent Design District to include the following: Corridor Alternative 4: Five Stories By- Right; Commercial Uses Only. In the area designated as the "Corridor" shown on Exhibit 1 attached hereto, the Crescent Design District ordinance and maps shall be amended as necessary to permit five stories by -right for nonresidential uses only; the fifth story must be stepped back a minimum 20 feet from the front of the building; and an option to rezone to residential uses on up to all five floors shall be included. 2 A RESOLUTION: TO DIRECT FINAL REVISIONS TO THE CRESCENT DESIGN DISTRICT 2. Performance Criteria. Additional performance criteria shall be included in the Crescent Design District ordinance to guarantee a mix of uses throughout the district, including a commercial -to- residential ratio requirement with an option for Council to vary the ratio during the rezoning process, and other standards such as increased usable open space and a residential unit type mix. 3. Crescent Design District Building Height Map. The Crescent Design District Building Height Map shall be revised to include four stories by- right for nonresidential uses only in the area shown on Exhibit 2 attached hereto. 4. Town Plan Amendments. The proposed Town Plan amendments shall be revised as necessary to be consistent with the revisions set forth above. SECTION II. Town staff shall present a draft Crescent Design District revised in accordance with the above at the January 7, 2013 work session and ordinances for action at the January 8, 2013 Town Council regular meeting.
